Tax grievance...Town of Brookhaven
I filed a grievance in 2013...In June 2014, I rec'd a letter saying we won...
I have not seen a refund check and my tax bill has not been adjusted...I've called 3 times and was told TOB is behind...
I filed 2 years ago and won almost a year ago- wth am I still overpaying and where is my refund????
Is this normal???

As far as the refund goes: The refund is not issued by the Town of Brookhaven. It is sent out by the Suffolk County Treasurer. Call the "cancellations department" there for the status of the refund check.
As far as the assessment being reduced going forward - the new assessment roll is being published on May 1. Call the Brookhaven Assessor's office and let them know you want to ensure the reduction is in place on the 2015/16 tentative assessment roll.

Interesting...
Zap my tax (the company I used to fight the grievance) says that all their other cases have been handled;except those for TOB... They kept blaming them being "so behind"

Your not alone my parents filed in 2012 never got their check or their bill adjusted. They went to court and have a court order for their check and bill to be adjusted from 2014 and they still have yet to adjust it.... The longer this goes on the more money they will be owed...

Tax grievance...Town of Brookhaven
We used mark Lewis to file a grievance in 2012. We won in 2013 and got a check around the same time we found out from mark Lewis that we won (a whole $400 lol) and this most recent tax bill is when I noticed a difference.

Hijack question: If the previous owner did the grievance before they sold and it was recently just won but we own the house now and she's out of state...to whom and where is that refund going?

It doesn't matter when the case was settled. If the seller owned the house during the tax year covered by the settlement, the refund is the property of them. If they started the grievance process, but you owned the house for the entire tax year the grievance covered, you would be entitled to the refund.
If you purchased the property during the settled tax year, any refund would need to be apportioned between you and the seller as of the closing date.
As far as where the check is physically mailed and how the treasurer's office issues the refund (to whom it is made payable), that depends on whether or not they used an attorney or another consultant or appeared pro se.

They already told us we would be responsible for the fee charged and it will be discussed at closing next week. In your case your sellers should have definitely let you know before hand. I agree I wouldn't have paid it either since it was an unaccepted expense.

That's what we told them...You might have wanted to bring that up at the closing table...the realtor was not happy!
