A few thoughts:
1. You need to get on the same page regarding the tenant. It shouldn't be "well you wanted her so you deal with her." That is not fair to you and that is how resentment builds. Whether you keep her or not you should be a team and figure out a system - take turns dealing with her or whatever you agree on comfortably.
2. You need to decide whether you want ANY tenant at all. Find out the market rent and decide if having someone in your space is worth it at that price. If you didn't have the tenant when you bought, would you have sought one out? Analyze the advantages and disadvantages and make a decision about tenant v. no tenant.
3. Decide how you want to deal with this person in the short term. Even if you want to get rid of her, make up a short term lease ASAP so she is notified of the rules. New rent, cut down the noise, etc. There is usually a clause about "quiet enjoyment of the premises." Meaning she has to be considerate. It goes both ways, actually.
4. If you do want to get rid of her - and I think you should - you might want to consult an attorney. Your local town and/or courthouse might also have information on landlord's rights.
5. I am a landlord and it kind of blows so I would only do this if you really need the money.

You weren't wrong in the least bit for texting her that late. She was being unreasonably loud and it's still your home.
I don't necessarily needed to ask her what she was doing up there but you had every right to ask her to tone it down because it was late and she was being loud.
As for the situation in general, I agree with the PP who said it doesn't seem like you guys are really good with being landlords. That's not the end of the world, it's not for everyone. I would sit tight until the six month mark and then give her notice that she's going to need to leave within "X" amount of months or by "X" month.

If you do decide to extend her, make sure you get a lease. It is in your best interest to have one that protects your interest & spells out the terms.

Just a thought... if apartment isn't legal then it should be easy to get her out....
Second lie.... when we moved in there was a guy so he stayed... but then he got a gf who was a loud moaner.... the final stra w was coming home to hear smoke alarm going off. Smoke filled the ceiling.... appears the guy charcoal bbqed. Called him because we could hear th e alarm from the car and he said didn't know anything..dh just said inlaws are moving in got two months

I also agree you need to know your rights and her's. You knew there was a renter in the house and yet you bought it. Yes you need "rules" but she pays rent and it's honestly none of your business about anything more then rent and the state of the apartment. Maybe she is depressed, but so what? Has that effected you as a landlord? Yes utilities went up, but that is the price to pay when you took her on and did not change the agreement then. I think it's very unfair to now possibly increase her rent and or add utilities. You should have talked about that before you closed. Sure the fan is annoying, but seriously if I was renting and someone was considering having me evicted or was maybe going to ask me to leave because I was walking around at night I would be pissed. Having her not run an industrial fan at 11:30pm is one thing, but not walking around in her own apartment is another. Yes I know it's your home, but it's also her apartment.
Sorry if I sound harsh, but I was in this situation and I guess i'm still bitter lol.

as a former landlord ( I have my mom there now)..I have to say in my opinion if you do not need the rental income do not rent..tenants rights are definitely heavily more favored than landlords rights here...our apartment was legal with itemized leases in place with rules and we still had issues...and there are just horror stories out there regarding evicting tenants...
I think its terrible that in your home buying process this situation does not seem like it was fully disclosed to you in a fashion that you would be able to think on it and seek advice on it before agreeing to keep the tenant on...

To the quoted poster - it sounds like you were in a bad situation and I'm sorry to hear that. Some landlords definitely do take advantage.
However, it's not unfair to revisit rent, utilities, rules, etc. in this case because the OP stated that they agreed to revisit in 6 months and that time is coming.
It's not realistic to expect new landlords to honor an agreement that involves some great advantage to the renter such as below market value pricing.
The kind thing to do is give plenty of notice if you intend to either to ask her to vacate or pay much higher rent but other than that, the OP doesn't owe the renter much at all beyond what is required by law.
Unfortunately when you rent from a private homeowner this is what you have to deal with.

It was a bad situation. New owners and my rent went from $1000 to $2200. It was awful. They were rude and would just show up to "inspect: the house. They said no cats even though they knew I had one and knew that before they bought the house. When I left they kept the security deposit because of the cat *eyeroll*. It's a tough spot. I understand it's your home, but for the renter it's their home too and they pay for it. Ya know?
OP it sound slike you aren't interested in having a renter and that's cool. I would just ask her to leave when the 6 months are over.
