Maybe you should start being mean to his face (soooo not my style either, so easier said than done) so that he doesn't feel like he can walk all over you. You have his as you assistant for a reason. I would almost be inclined to let him know that he needs to get his act together or bring you a Dr's note... if he's calling you a few times a day, how sick can he really be

absolutely demand a doctor's note before he can return to work.
He's most likely pushing to see how far he can get and maybe a little po'd that you got this position and he didn't.
No note no job that's what you tell him when he calls to 'check in" later today cause you know he will.
Careful everybody- you can't just demand that someone provide you with a doctor's note!

Call HR and ask. Say "I have an employee who's taking multiple sick days and was just curious to know if a doctor's note is required for extended absences due to illness."
If there's no policy, you can't demand a doctor's note.

If someone is sick and they have sick days I am pretty sure you are not allowed to question them on it.. I think if someone is entitled to a sick day then u cant expect them to come in.. You honestly dont know if he is sick or not..If he is SICK u cant expect him to come into work even if it is 2 blocks..plus maybe he feels that he doesnt want to get others sick...if u feel like sh*t i can pretty much guess u can gage a 100% turnaround over nite...
u CAN ask for a dr's note but honestly i dont know why ur mad.. i never get why a boss gets peeved when workers call out sick.. it is an emplyees right to use sick days..
and most of the time, i think boss's feel that they r above the rulz and basically if they were sick they'd be out without justification or question...

You say he has alot of sick time saved. That he's not one to take the lead. That he's not upset that he got passed over and you got the job and you're, also, much younger than he is. From where I sit, it seems to me he's plenty pi**ed off. He's, obviously, been with this company for quite a while and he knows when the busy time. So, he chooses this particular time to get "sick" and not for just a day, but, two and, possibly, three. He's playing a game and seeing how far he can get with you. You should demand a doctor's note and let him know that you may have to bring in someone to help you since he is so "sick" that he is not capable of coming into the office. If you have an HR department, I would talk to them about absences and what is tolerated and what is not. He's testing you. Watch out for the quiet, laid back ones. They'll get you every time.

First thing that struck me when I read your post was comparing yourself to someone else. Don't do that. Everyone has their own life outside of work and if they are entitled to sick time, then that's that. Second, does your company have a policy as to when to bring in a doctor's note? I totally know what you mean about being annoyed and swamped but don't let your emotions overrule the facts

I'm mad because I'm venting and worked until 8:30 last night. And since I've started here, he's always out for one reason or another. And when we're busy, he still leaves on time, arrives on time, and never eats lunch at his desk. I guess I just expect too much from people; sorry if I sound like a beyotch....I would never be rude to his face. I seriously just told him to feel better. But telling me you'll be out tomorrow at this early point in the day is just lame, IMO. (I go above and beyond at work, paid for it or not.)
You don't have to be rude to be his boss and tell him you need him to work late. You can just tell him "I really need you to stay late tonight until we finish this" (as early as you know) or "tomorrow, I may need you to stay until 7 because of XYZ." It's not rude - it's his job.
ETA - but as for the sick time, if he's entitled to it, I wouldn't question it.

unfortunatly not everyone sees there job the same way..i guess he feels as long as he does what he "has to do" then he will get paid and call it a day..but as long as hes doing whats expected of him, and within HR guidelines I guess there is not much more ya can do...
Im not bashing u at all just so ya know..Im speaking more general.. If I was you (the boss) I guess i would be mad too but maybe u can speak to him on the side and just let him know that on urgent days unless hes "Dying" ud really appreciate the extra help.

My companies policy is if you are out sick for two or more consecutive days that a doctor's note is required to return to work.
Her company may not have the same policy. So, if she "targets" this over-40 employee, she could be looking at an ADEA claim.

He obviously doesn't care about his job like you do....He just puts in his time and collects a paycheck......
I have to add, though, that when I had the flu, I called in the night before because I was knocked on my azz and KNEW there was no way I would be better the next day.

I was just going to post this.
and you know what, if I am sick, I am sick. I live close to my job too, but if I am sick enough to stay home (which is rare) I am not getting my arse out of bed to pick up some work.
you are annoyed b/c more work falls on you...completely understandable...but it doesn't take away from the fact that he may very well be legitimately sick....
OR...
he's sipping a margarita on the beach in Cancun. Check for tan lines on Thursday
