Those who took off additional maternity leave than

...what your company allowed / paid for. Did they pay you for the 6 weeks that you are "entitled" to - I have it phrased like this -"entitled" as I am not sure the rules about this.

I am the only employee for our company. I want to take off 4 months. Are my employers obliged to pay me for 6 weeks of that or because its a small company are there no rules? we have no HR to ask.

Just looking for anyone in a similiar situation or any advice.

I would check because I'm sure all company's are diff. When I had my 2nd son I got paid for the 6wks but after that I got NOTHING and they didn't have to hold my position either but I was guaranteed a postion when I came back just wasn't sure which one. Luckily when I went back (3-4mos later they did give me my position back which was very nice).

Since you are the only employee you wouldn't be covered under FMLA so they wouldn't have to hold your position for 12 weeks. Under NY State I think you would be entitled to 6 weeks disability if you have a vaginal birth or 8 weeks if you have a c-section. That amount though is minimal. I don't believe that a company is required to pay you above the disability.

I took 3 months off. My company paid me zero. The state gave me my 6 weeks disability but that is it.

I was able to take a year and have my job held, unpaid! I took 6 months...state will pay 6 weeks

I work for a smallish company. Legally they have to allow you 6 weeks off. They DO NOT have to pay you. That's at their discretion. Because we are less then 50 employees FMLA means nothing to us also.

My bosses in the end offered me 6 weeks paid with a total of 90 days off to come back to MY job. this is what I did.

If you're the sole employee they don't have to hold your job at all - they can cite you being out as an hardship that they cannot handle.

I work for a large company, took 5 mos and was paid for 8 weeks (4 weeks 100%, 4 weeks 2/3 pay) for c-section birth. I also had to take 1 week of my vacation.
