I have deposited other people's checks. I endorsed their name and then signed my name with my acct number. You can really do this.
But could I go to jail if someone found out? I mean 99% no one is going to know, and it's my dad's name, we have the same last name, so the bank would suspect nothing... but still. I don't want to do anything illegal.
I sign my mom's name all the time, but with permission

I think what I will do is email him with the number all of the information and what he has to do, and if he does it, great, if not, I have my health and my sanity. $400 is not the end of the world.
It is SOO tempting to just forge it and take the money and run.
Thanks for the advice. maybe he will have a heart. It is my birthday next week. It's the least the a-hole could do.

I hate to throw you a wrench, but a few weeks ago, I tried to deposit a check written to my DH. He DID sign the check, but they wouldn't let me deposit it because it was written to him and not me.
I had to raise hell and they finally deposited the check because I've been banking there for 10 years and know the manager now.

you are forging his name on a check, it is absolutely ILLEGAL.
I cant believe people are telling you to sign it.
even if your bank lets you deposit it (they might not), they have years that they can take recourse if they find out.

They won't do it. I even explained that it was my car and I assumed the repsonsibility and could prove that I had paid the bill. They still need his permission. I understand where they are coming from, they don't want people to be able to make claims against other people's warranties. it's just super annoying.

Why can't they just send the check to your Dad in his name. Ask him to deposit the check to his own account. Then have him write you out a check from his account for the $400. And you don't lose a penny.
I don't see what the big problem is. It may take a little while, but so will the whole rigamoral of endorsements and attorneys and whatnot.

My dad is an a-hole.
I posted above how he wouldn't sign the car over to me even though he just left it about to be repossed and I didn't even know it, and I had to pay $4K within 2 days.
I think that gives you an idea...
EYTA: if my dad were normal, it wouldn;t be a problem, I could A) get his permission to sign the check, or B have him cash it and give me the money...unfortunately that is NOT the case.

I have done it with my Dad's name and with Jake's- Jake normaly signs it and then I put it into my account - which he is not on ( b/c he is too lazy to come to the bank with me)
but I had permission when I signed my Dad's name- the check was only for $25

If you don't want to do anything illegal, then don't do this and, yes, you could be arrested and prosecuted. My niece was arrested for this not too long ago (she was 22) and her parents spent a great deal of money to get the charges reduced and for her to not spend any time in jail. If your father would not have any problem causing trouble for you, it will cost you alot more than $400 to straighten out the mess. He has the car registered in his name and the insurance as well. He could, easily, find out about this. You need to get the car in your name and you may have to sue to do it. This is forgery, pure and simple, and, could cause you a world of trouble. If you can't get him to sign the check over to you, then you may have to take the loss.
