Uh-Oh!! S.D. Governor signs Abortion Ban into Law!
PIERRE, S.D. - Gov. Mike Rounds on Monday signed legislation banning nearly all abortions in South Dakota. The Legislature passed the ban late last month, focusing nationwide interest on the state as the governor decided what to do about the measure. The law, designed to raise a direct challenge to Roe v. Wade, the 1973 U.S. Supreme Court decision that legalized abortion, is scheduled to take effect July 1.
The bill would make it a crime for doctors to perform an abortion unless the procedure was necessary to save the woman's life. It would make no exception for cases of rape or incest.
Planned Parenthood, which operates the state's only abortion clinic, in Sioux Falls, has pledged to challenge the measure in court.
Rounds issued a written statement saying he expects the law will be tied up in court for years and will not take effect unless the U.S. Supreme Court upholds it.
"In the history of the world, the true test of a civilization is how well people treat the most vulnerable and most helpless in their society. The sponsors and supporters of this bill believe that abortion is wrong because unborn children are the most vulnerable and most helpless persons in our society. I agree with them," Rounds said in the statement.
The governor declined all media requests for interviews Monday.
The Legislature passed the bill last month after supporters argued that the recent appointment of conservative justices John Roberts and Samuel Alito have made the U.S. Supreme Court more likely to overturn Roe v. Wade.
South Dakota's abortion ban is to take effect July 1, but a federal judge is likely to suspend it during a legal challenge.
Rounds has said abortion opponents already are offering money to help the state pay legal bills for the anticipated court challenge. Lawmakers said an anonymous donor has pledged $1 million to defend the ban, and the Legislature set up a special account to accept donations for legal fees.
Under the new law, doctors could get up to five years in prison for performing an illegal abortion.
Rounds previously issued a technical veto of a similar bill passed two years ago because it would have wiped out all existing restrictions on abortion while the bill was tied up for years in a court challenge.
The statement he issued Monday noted that this year's bill was written to make sure existing restrictions will be enforced during the legal battle. Current state law sets increasingly stringent restrictions on abortions as pregnancy progresses. After the 24th week, the procedure is allowed only to protect the woman's health and safety.
About 800 abortions are performed each year in South Dakota. Planned Parenthood has said other women cross state lines to reach clinics.

Well, it sounds like they want to try and take it to the Supreme Court. Good luck with that. I doubt it'll happen.
I heard that this is there intention- however- the chances of the court hearing the case are slim and based on the old and new justices the news report I heard says they don't feel the case will be over turned

I am preparing to get flamed for this, however this is JMO. I know I am in the minority on this, but I have to say I agree with this statement that I quoted. Unborn children are the most helpless persons in our society and I am personally against abortion for MANY reasons. I just wanted to post a different point of view. Normally I would not post about something I did not agree with (for fear of getting flamed) but in my heart I felt I had to post this.

Yeah... the bottom line is that women will still get abortions whether they are legal or illegal. But making it against the law you are forcing women to submit to dangerous practices that are unsanitary and often not even with a licensed doctor.

no flaming from me. you are entitled to your opinions/feelings, just like everyone else. and you did so eloquently, without admonition to others with opposing views.
this bill does not make allowances for rape and incest...this is the scary part imo. what happens to a woman's right to choose, should she be faced with an unwanted pregnancy from either one of these scenarios?

While I agree with you on many levels, making all abortion illegal except for in the case of saving the mothers life this is going to force a black market on abortions. They are going to become unsafe, unsupervised which will put the women who make the decision for themselves to have one at risk. Also it may bring a lot of babies into this world who may not be wanted, left for dead after birth, no prenatal care, the list goes on and on. I am pro choice and I think that telling women, even those who have been raped, they must carry and deliver a baby is wrong.

Everyone is entitled to their opinion, pro-choice or not but I firmly believe that you cannot legislate reproduction.
And with the SD abortion ban, will they provide sex education and access to condoms? Will they care more for those children who are already living in poverty or suffering from abuse? How can a party claim to care about a zygote than children who are LIVING and being abused?
Just my two cents.

At this point, that seems to be the best we can hope for - that it won't be heard on the Supreme court level.
I can't imagine what the women of SD must be feeling right now...I've never been so thankful to live in NY before.

I mean I am pregnant, and when I saw my child's heartbeat at 6 weeks I started crying with joy. I heard it and saw it, that baby is a living thing IMO. So I feel an overwhelming sadness when people say it is not a living thing or try to downplay that fact that you can see and hear a heartbeat at 6 weeks. I mean I am not a proponent of wire hangar abortions or anything like that. I don't want ANYONE to be hurt. I just wish that women did not use it as a form of birth control. Would adoption be such a horrible option to even consider???? I have had discussions with people who say that is it easier to have an abortion then to give a baby up for adoption. Why is it easier in their minds? So many people want to adopt. My Dh and I were considering it because I was told I might not be able to carry a baby full term because of a health condition that I have. Then, (after a ton of tests) my doctor said I could get pregnant. I still might have to have major heart surgery, or a transplant right after birth, but that is the risk I took to have a child. I guess when you are told you might not be able to have children, and then you can, your perspective changes.

I don't think the Govenor's religious or ethical views should be inflicted on a whole state. On his family, kids, grandchildren, fine.
I am pro-life, however, that is what I have decided for ME. I don't think anyone can tell us how to think or feel.

Hey, hun, I feel ya, I've got 2 kids myself and I view the miracle of life just as what it is a miracle. I guess people think that an abortion is easier because they never feel the kicks, never actually give birth so outta sight outta mind I guess. A baby has never really become real to them yet. I don't think it's right that any government should be able to tell its citizens what they can and can't do when it involves their own bodies (yes, I know it's a baby inside a womans body) but it is still up to the mother to be. IMO.

I am just curious- I would think that once you become a mother your opinion would change?
I didn't change my opinion at all. I still feel in utereo, a baby is not a promise but a prayer until it is out...and then it's becomes an even bigger prayer as you hope with all of your heart that your child lives & is healthy every single day.
While I'd never want to see my daughter (or son) have to make those choices, I want them to have safe choices available to them. I am more pro-choice than ever before because of them.

Even tho I am having major fertility issues, I still would not force my beliefs on someone else. I think it is and should be a woman's own personal decision. I have friends who have had abortions and I would never have told them what to do.
I agree, when God willing I do have children I would like them to live in a free country, moving forward in women's rights.
