*UPDATE 2* Ok what do you think the final outcome of this will be

So I called yesterday and left a VM message for the owner that I had spoken to last time.
today-still haven't heard back so I called again. He told me the other owner is handling this now (the one who i actually dealt with the night of) and he is either going to go through Insurance or pay me out directly. I asked that he have him call me to advise me of his choice as I know Insurnace would take awhile. I also asked if they would need my address to send the check to, since they didn't have it. he said yes fax it over. I hope they really do the right thing, and are not just saying the right thing. I will follow up with the other owner in a few days. I can't see how or why they would go through insurance, its less then $500. I thought deductables were usually at least $500. but maybe I'm wrong.

*Update 1/20/09

So I called last night since i'm not close to this place, and I had no idea if they were even open to bring them the reciepts. I got the other owner who seemed much more compassionate then the other owner. He said he was very very sorry, and to fax him copies of my reciepts and my contact info and he will give me a call. lets pray he does the right thing! I'm sending them over now, and I'll post when I hear back from them. hopefully today!!

Friday night DH and I and 6 other friends buy tickets to see a comedian at a place (that will remain nameless for now) There is a 2 drink minimum as most places.
We had our 1st round of drinks. the comedian takes a break, we all order our 2nd round. everyone except me and 1 other person stay at the table during the break. Everyone else went to the bathroom.
The waitress is trying to get by with a tray full of drinks and all our full brand new drinks already on the table when of course she lost her footing, and dumped all the drinks on the tray on me, as well as knocked into the table so every single drink spilt everywhere.
I quickly pick up our jackets (both wool) that are just dripping with alcohol. My friend grabs my purse and starts digging out stuff she thinks is important. It was on the floor right next the table, and it just filled with all the run off from the table. Needless to say she takes my phone out of the front pocket that had about 4" of alcohol in it.

My blackberry was soaked! DH and friends return to the table and help us to wipe it up along with 2 waitress. The one who did it kept apologizing. My jeans and sweater are soaked mine and DH's coat is soaked and my phone is not even on anymore. DH takes it apart and lets all the liquid pour out of it.

It won't stay on to make a call, the flash for the camera (that i didn't even know i had) is stuck on, and if your turn it off, as soon as you leave the camera mode it turns right back on.
So I take my phone and my jacket and go look for an owner. He was nice, but you could tell he wanted nothing to do with it. He took my phone and took it apart, put it back together and says see it works I explained to him it doesn't make calls and that flash is not supposed to be on all the time. he says just let it dry out. he goes to the register and gives me $30 cash for dry cleaning.
I go back to table mad, with the money in hand and show DH, and tell him that its at least $50 per jacket and he has to pay for my phone. Everyone at that point gets up. (3 people go home) the rest of us go over the owner again and nicely explain that $30 doesn't cover the dry cleaning. He gives us his business card an said call me on Tuesday or the other owner and tells us his name, and says bring the bill for a cell phone if it doesn't work and your dry cleaning bill.
He then says lets not let this ruin the night let me get you guys another round of drinks on me (which he did) and i will sit you at a table in the back so you can sneak in and still catch the show. (In my heart i felt like he was just shutting us up) so we go ahead and watch the show.
The end of the night comes and they bring us a bill. 3 rounds of drinks!!!! We only drank 2 and the 3rd was spilt all over me! I didn't want to ruin everyone's night but I had to sit completely uncomfortable in wet clothes, and I have to freakin pay for it!?! So DH and another guy friend him again and he takes the bill and krinles it up and says oh, so I guess you guys just shouldn't pay for anything huh? DH said no, we want to pay for the drinks we drank, not the ones we didn't! so he went back and took them off the bill.
We left my cell phone apart all day Saturday hoping it would dry out. No luck, Sunday came and it was still not working.
We went and bought another blackberry (which I even saved them $ on, it was cheaper then getting the same one I had) And today i will drop off the dry cleaning.

If you made it this far, do you think they will do the right thing and pay for my cell phone and dry cleaning?

Based on their previous actions.. I think you're going to have to be pretty hard on them to get them to do anything.

Unfortunately, i don't think they're going to do the right thing. I'm sure they won't take your calls and will just ignore the whole situation.

BTW...there is NO WAY I would have paid for any drinks. I can not believe they charged you for the night!
My friends could have stayed and enjoyed the rest of show if they wanted, but I would have walked out for they way I was being treated.

They really are going to have to be convienced to take car of those things.. it honestly doesn't sound hopeful.

But I have a feeling they're gonna be jerks about it. You may not get your money back. But it definitely suxx.

I don't think that they should have given you a bill at the end of the night. I would definitely go to the club with copies of all of the receipts (keep the originals incase the club loses them). They should compensate you, but I have a feeling that they won't. Good Luck!

I doubt you will get satisfaction.

You can try, but be very firm.

Those tables at the comedy clubs are so close together and tight. I hate that.

ITA - you should win in small claims court! you are in the right to have everything paid for...and don't forget to put the court fee in the claim.

but I hope that they will not let it get that far.

They should have comped the whole night and paid for the phone/dry cleaning. When DH & I were first married we went out to dinner at chilis and a new waiter lost his footing and a plate of food landed on me. Not only did they comp both meals they paid the $70 in dry cleaning and apolgized profusely.

you are out over $200+ dollars....sorry but they should pay for that

I agree.

If he was a good owner - he would have comp'd the ENTIRE bill - meaning, ALL of the drinks: the ones you did drink and the ones you didn't. He would have then offered to pay for the entire dry cleaning bill AND offered to pay for a replacement phone... NO questions asked!!

ON TOP OF THAT he should have given you free tickets to return along with a voucher for drinks -- just as a nice thing to do. As an owner you have to try and make things right by the customer... Of course the waitress didn't mean what happened but good business is to try and compensate the customer as much as possible.

I can't believe that happened and you DIDN'T tell me the story on Sunday!
