Update at bottom - Maternity Leave
My maternity leave is suppsoed to start next tuesday 6/1, I set it for 2 weeks early as my dr. was concerned I would go early. I had my 37 week appt last night and since I have not dialated anymore and my blood pressure is back to normal they are no longer concerned. Should I push my Maternity leave start date back and work up to 39 weeks instead of 38, so I have more time with the baby afterwards?
So i told my boss i wanted to work next week and take it day by day as my Dr. approved me to work until 39 weeks. I was told thats great and i'm more then welcome to keep working, however they still need me back on 8/25 because the girl covering me is going on vacation that day and my boss will be out at meetings all week...... If company policy is 12 weeks unpaid leave, how can they make me come back after 11 weeks?

My vote is for yes for the sake of having more time afterwards.
However, I would take into consideration how far the office is from the hosiptal you're delivering at - just in case.
If its far I wouldn't risk the chance. Anything can happen & change in a minute.

YES!
I worked until the day I started having contractions (a Wednesday) which was 2 days before the actual birth (a Friday).
Believe me, I wanted every possible MINUTE with that baby!

My DH is concerned because I work 26 miles from our house and about 30 from the hospital. He was teasing me this morning that I will be like the lady that delivered her baby in the car the other day.

Yes definitely push it back as far as you can. You much rather have that week or two extra to spend with the baby. My job mandates you start maternity leave 4 weeks before (you can't add it on to after) and by week two I was so bored.

as long as you have a plan for how to get to the hospital god forbid you go into labor at work, I'd push it back to spend more time with the baby

So I told my boss I wanted to work next week and take it day by day as my Dr. approved me to work until 39 weeks. I was told thats great and i'm more then welcome to keep working, however they still need me back on 8/25 because the girl covering me is going on vacation that day and my boss will be out at meetings all week...... If company policy is 12 weeks unpaid leave, how can they make me come back after 11 weeks?

they can't. its not your problem that the girl covering you is going vacation. its their problem.

U are covered under the FMLA for 12 wks- it's their proble to get coverage for you while u are out. do not let them "make" u go back early!!!!

It depends on if it is FMLA or not.
Her company policy can be 12 weeks unpaid, and they would have to let her take all 12 weeks because that's what they give to everyone. But if that's just an informal, unwritten agreement, and her company does not qualify for FMLA (must have 50 or more employees) then they can make her come back after 11 weeks.
FMLA does not start until AFTER the baby is born - you cannot take a week or two of FMLA before the baby comes. You can take whatever paid/unpaid leave your job offers, of course, it just won't be FMLA.

If your doctor takes you out of work for medical reasons before the baby is born, your FMLA leave will likely start running at that point.
Are you working at a place with at least 50 employees within a 75 mile radius? Have you worked at least 1,250 hours in the last 12 months? If not, you're not entitled to FMLA. If you are entitled to FMLA, your employer cannot force you to come back early. You're allowed to take the 12 weeks of leave.

Thanks ladies! I checked with our external HR department and was told that I would get 12 weeks FMLA (unpaid) and I could use any vacation time i have accrued (up to 2 weeks) prior to/post my delivery per our employee handbook. So really I can take 14 weeks if i wanted to. So i put in to stay working next week and move my leave to start on 6/5, and i am going to work part time the first 2 weeks I am back using my vacation time. Being there half a day the week they are out is better then me not being there at all!

Yes....and since you are entitled to 12 weeks...I would make sure your boss understands that you will be taking the full 12 weeks. How often is it that you will be out for having a baby??? Talk to HR if they give you a problem.
