And this is why our insurance rates are so high. This should never have seen the light of day. Is there no "common sense" clause built into cases these days to prevent such a waste of time and resources that could be spent putting real cases before a jury? What a screwed up system we work with.

Do a little bit of reading about it and you'll see that it was an insurance case. CT has strict rules about when and how an insurance company cannot be a named defendant in certain types of cases (guess why?)--and this was the only way for her to get the money from homeowners insurance that she needed to pay her medical bills.

Read more and you'll see that the family is very much intact and she is quite close with the nephew.

I wonder if the deceased mother was in on it with the sister before she passed. Like hey, sue my homeowners insurance and we will split the payout if you get it. It wouldn't affect her, the insurance would pay.

What I don't understand is if she had to sue an 8 yr old. How did she/they expect him to pay?
I can see suing the home owner since it was a juvenile that injured her.
Even the 8yr old with the home owner.
But just an 8yr old?
This doesn't make sense.

It's a ****** thing to do. I am being sued by a former friend who fell down at my house. I'm sure she thought it was nothing personal, and she was just going after my homeowner's insurance. Well, it is personal. The lawsuit claims it is my fault that she fell, and that she suffers from permanent damage, which is untrue.

Also, this happened three years ago and it is still going on. So I'm not surprised at the length of the woman's lawsuit. She may have sued right when it happened.

Even if you have insurance they don't want to pay if they can blame someone else. My son bit through his lip. It didn't require stitches, only a Drs visit, I received a letter from our insurance company with a set of questions about how he was injured, who else was involved etc before they would pay. I can only imagine what they do when the bill is thousands of dollars.

This is going to sound strange, but when I broke my shoulder, I had some problems using the stairs. It was my right shoulder and since you have to stay on the right side, I had nothing to hold onto. My balance was sort of not right. The elevator in this particular building was one of those hop-on hop-off elevators (Paternoster), so the stairs were my only option. I just stayed to the left, but people were not happy about it.

So maybe that was her problem?

I saw her on TV this morning (and her nephew was with her and they have a very good relationship) and yes, she sued because that was the only way to attempt to get payment for her medical bills. The nephew would never have been personally responsible for payment if she won - the homeowners insurance would have paid. And it's not like she just decided to sue recently. Unfortunately these cases can take years to work their way through the legal system. I'm sure it started soon after the incident, with a claim to the insurance company and when the refused payment, she was advised by her lawyer to commence a lawsuit. Not saying that she had to pursue the lawsuit, but if for whatever reason she didn't have her own medical insurance, that would be the only way for her to attempt to get reimbursed. And from what it looks like, she was only seeking $$ for the medical bills. Usually, when someone is injured and sues, it is for MUCH more than just the amount of the bills (for alleged pain and suffering etc).

I feel terrible for this poor woman and poor child.

I agree. I also see nothing wrong with recouping medical costs even if it was an accident. If my kid accidentally causes someone to incur unreimbursed medical expenses, I would feel responsible for them.

I think the hype over she sued an 8 year old is ridiculous & it shows a serious lack of empathy.

I'm waiting for someone to bring up the "ridiculous McDonald's lawsuit" where an elderly lady literally had her labia fused together after McDonald's was repeatedly warned & asked to lower the temp of their drinks because of other burns sustained by customers.
