What a day, filed a greivance with my Principal based on building senority and...
I teach for the past 9 years in the NYC Public Schools. I have been doing Pre-K for 5 years. My colleague has been in Pre-K for two years. Another colleague got Pre-K (had asked for it for a couple of years--based on rotation). So, this meant my Principal had to bump someone out. She decided on me, but I have building senority so I am fighting it! God, I hate this! But..I am a believer of standing up for your rights! This is what we have a contract for with rules!
Anyone ever been in this position before?
Thanks for your replys ladies. However, then why is there an article that stipulates building senority if all qualifications are the same? I know about the issue of not getting your first choice two years in a row, but this above article is an issue too...

i don't know how it is in NYC schools, but seniority has nothing to do with grade level placement. yes, it matters in terms of being excessed, the less senior person would go first, but in my district, the principal has the discretion to move people where he/she sees fit.

Same in my school.

Is it possible that you were the one who was most capable of handling the change? There could be so many reasons for it. Definitely talk to your principal and see what the deal is.

In NYC grade level placement is based on seniority.

placement is not based on seniority. as long as you get something on your preference sheet, i do not think you have a grievance.

And regarding the preference sheet I think you can only file a grievance once you have not gotten one of your choices for two years in a row and you have to document that.

Yeah - as far as I know you can file a grievance if you have not received your first choice on your preference sheet two years in a row. There were a few teachers in my school who wanted to file after not receiving their first choice last year and they were advised not to. I don't really think it has much to do with seniority.

In my NYC school if I want to teach 11th grade english and have been there 5 years and Ms. Smith wants to teach 11th grade english and has been there 7 years....she gets the class.
They do have to give you one of your 3 preferences but if you really want the same class as someone else and both list it as # 1 then the most senior teacher gets it.

Re: What a day, filed a greivance with my Principal based on building senority and...
Exactly, that's what I think. So maybe my grievance will be honored???? I've been in the school since the year we opened (2001), the other teacher came two years later. I have had Pre-K for 5 years, her for 2 but we both got our first choices of it for the past two years. Since someone else is coming in based on rotation (another article in the contract) then the one who should get bumped should be the teacher with less building senority!
I am also fighting an out of classroom postion. I've been asking for it for 4 years, the same teacher has had it for 7 (based on rotation)
