I am sooo sick of people suing for nonsense. Yes, her picture was posted in error. So what?? Ever single day people are arrested. That is a fact. Posting a photo to show who has been arrested is just that . . . a photo saying this person was arrested.
Look at it this way . . .
Those Duke athletes accused of awful crimes had their photos splashed across the newspapers all over the country. Were they guilty? They were accused of a crime and arrested for it. I don't see them suing because their photos were printed.
 Thank you. Me too, one of my biggest peeves in this country is the amount of suing that goes on.

And how is she supposed to now get the word out to people that it wasn't accurate, to clear her name? I personally think she has every right to sue and she should and she should win. Seriously, I don't believe she deserve 1 million dollars for this. A small settlemment (a few thousand $$), maybe but IMO it is a frivolous suit.
Sort of off topic, but with civil suits you HAVE to say you are suing for $10 million dollars or some absurd amount like that because if you said "I am suing for $5,000" that limits the value of it. Even the smallest car accident case that settles for $1,500 says that in the summons and complaint if it is started.
You are not ACTUALLY suing for $10 million dollars and I explain that to most people. People aren't going to ever GET $10 million for this.

If it were me, no I wouldn't sue. I wouldn't sue someone unless there was serious harm to my character and or physical person. If my picture was removed and it was noted in the newspaper that I wasn't drunk. I would carry on with my life.

Silly... The wall of shame is a great thing. They post pics all over the country on sherrifs websites of the mug shots of people who were arrested they aren't found guilty yet but were arrested.
If she was having an attack where was she driving too?

I don't agree with frivolous lawsuits at all. I don't believe this is a frivolous lawsuit. Her reputation, career, etc. could be damaged as a result of being publicly labeled a "drunk driver". IMO, suing McDonald's b/c you coffee is too hot is a frivolous lawsuit. Not this case.

I agree..I wouod also sue if it were me, but then again my job would be in jepordy.....As far as "getting her medical condition under control" That p*sses me off......I know MANY MANY MANY people who do very well at controlling it and then they get a common cold and their sugar drops to 30 with out them having time to fix it. I have no tolorence for people who A S S U M E people are guilty of something even before they get a chance to make a decision. I work in EMS and I have seen this so many times and it is horrible.
I think you bring up a good point with this. I don't think everyone can control their medical conditions at every minute, even if they try.
ITA 100%. I have a fmaily memeber who is diabetic and has it completely under control.It can be the littlest thing that drops his blood sugar. Medication he is on for an eye infection or a cold and he goes into a diabetic shock. Things just happen! I think this woman has every right to sue and i hope she wins.

i have MANY family members with diabetes---it runs in our family. 
those family members know that when they are on meds of any kind, they don't drive. ever. my mom is always driving my aunt places because she won't chance it when she's not feeling well or is under a doctor's care. it's part of her life now and it's her responsibility to take care of herself and others.
that woman was driving erratically and on the sidewalk. she could have killed someone.
i don't know her situation obviously, but i think people suing has gotten out of control. you don't deserve money because you were wronged.
like someone said, those poor duke kids were thrown through the mud for over a year and they're not asking for a dime.
i feel badly for her but embarrassment isn't cause for suing. we are in such a sue-happy place and it's out of control.

I don't think she should sue, I am also a diabetic.
ETA: If you are going to get behind the wheel of a car, you better make sure your diabetes is under control. I can tell before I have an "episode" that it is going to happen. It is enough time to pull over.
Not everyone is aware when an an episode is going to come on. I have several diabetics in my family - type I & II - and some are in better control and have better awareness than others.

Maybe the penalty for drunk driving should be stiffer people wiggly out of convictions and get a slap on the wrist if crimes had some serious jail time maybe people would think twice.
Diabetics and driving can be very dangerous. How about people with seizures they are not allowed to drive. Chronic conditions that alter your mental status and cars don't mix, I have family on the road
and don't they make bracelets for people with conditions such as diabetes so when they are having and episode people will know what to do for them?

Diabetics as well as seizures can be controlled. People with seizure disorders CAN drive but not if they have had a seizure with in the past 6months. To say that diabetics should not drive is like saying if you are tired you should not drive. These are medical conditions that, for the most part, can be controlled, but like any medical issue things happen. Yes they make bracelets and yes some people wear them, but they are not mandatory nor should they be. I think this is a case of somebody who saw a "drunk driver" and never thought to CONSIDER something else. There have been many accidents I have been to where people had the accident because they had a heart attack, or a seizure, or a diabetic issue. If I would have just looked at it as an accident pt and not considered WHY they had the accident they would not have recieved the care they needed. Also cops are explained these medical conditions so they CAN make a diffirential diagnosis btwn being drunk and being sick

I feel for the woman, and I hope she wins the lawsuit and newday starts posting the pics AFTER conviction.
A women at my job was on the wall of shame, the whole company (1000+) people knew about it within days because of newsday. Gossip spreads fast. Her total professional reputation was ruined. My job offered her a package to leave (they dont like bad press) and she accepted becuase of humilation. I dont know if she was guilty or not, but the damage was done. If her situation was the same as this lady that is a devestating effect on your life.
The wall of shame needs to be changed to post pictures after conviction.

See, part of the problem is that most people don't know the definition of legal slander. For it to be slander (or libel) not only does the statement made have to be false (In this case it wasn't - she was in fact arrested for being under the influence of drugs), but the person making the statement had to know it was false at the time it was made. Now, it she wants to sue for false arrest or something, that is a different story (and I understand that is part of her claim), but IMHO she isn't going to win their either because her driving behavior to any reasonable person (cop or not), of driving up on the sidewalk, crossing the line and swerving into oncoming traffic would lead the reasonable person to believe she was driving drunk or under the influence of drugs. AND that is what you need to make an arrest- reasonable belief.
FRIVOLOUS lawsuit!!!

I disagree completely and I think she has EVERY right to sue, I know I would. They basically said, this woman was arrested for DWI, when she was not, in fact, drunk
I do not think this is a case of a friviolus lawsuit...I hope she wins

it's really not a fair comparison- but I am not the one that made it (you did)- I just wanted to point out that they are in fact suing
their situation was about 1 million times worse- they have many reasons to sue for
but the main reason for both cases is that they are wrongly accused of something
their photos were all over the WORLD- they lost everything

They do. It's at the top of the page and the part that say's "all are persumed innocent unless proven gulty" Is highlighted in red.
The office of the Nassau County Executive releases the photos of individuals charged with DWI. Defendants under the age of 19 are excluded. The gallery represents the charge at the time the photo was taken. Newsday.com will not update the status of these cases. All are presumed innocent unless proven guilty. All 'Wall of Shame' photos
