WWYD regarding carpet co not giving us a refund?
They installed carpet for us and broke our chandelier. They guy came to see the damage and we all agreed he would pay us $300 for the chandelier. We haven't gotten our check and its been MONTHS. Excuse after excuse. I went in there nicely one day and told them we need our whole basement carpeted, they same guy came to measure, gave us an estimate ($5000 worth of carpet/tile). I said OK, lets settle the $300 by you sending me a check and then we will proceed w/our basement.
STILL no check. Well, I'm not having them do our basement now but WWYD? We've gone there, called, etc etc. Its a reputable company on Jericho tpke too. When we have gone there we are told either the woman that "writes the checks" isn't there or they guy that told us hed give us the refund isn't there. When we call they mysteriously aren't there or need to call us back after they find the file???

i would first send in writing via certified mail a letter to the company warning them that if the claim is not settled in X amount of time, you will take further action including BBB, AG, etc. If they don't act, then it's open season on them.
is this a chain place or a mom and pop?

Sue them in small claim or contact 7 on your side. It may be a long shot, but they always seem to get things done! Have you threatened them with saying you were going to call BBB?

Call again and if they give you the run around, tell them "no problem,,I am hanging up and calling 7 on your side. The next time you see me, will be a tv crew and your company plastered all over TV".
Watch how fast you get a check!!! Similiar thing happened to me with a reputable company and a worker from the company was at my door with a check within 2 hours!

Send them a certified letter demanding the amount w/in x amount of time (or that you will pick it up on x day x time so no excuse the lady is out it can be waiting for you.) Advise them that if it is not there at that time you will immediately file a small claims suit and will contact the BBB etc.
I would do that before you sue - b/c it will be a lot of time and energy if you sue them for only $300 - I would only do that as a last resort. But at give them notice in writing- certified so they cannot claim they did not receive it.

I am well aware of the process - but some people have to take a vacation day or personal time to do it so they miss work - so that might be more of a loss if they don't want to take the time or don't have it to take- which is why I said it is time and energy - if she has the time to spend then she should very well go ahead.
LOL I had to go and sit in court several times for law school and it was funny - but as I mentioned not everyone has that time to give to it.

I'm curious...how easy is it to collect from small claims court?
I know someone who sued years ago and won, but was never able to collect the funds. They just gave up on it.
