Work horror stories....please share
I need to know what I am going through can't be as bad as others have dealt with.....
Case in point: I was working for a total beyatch the last 5 months. Every day was a struggle to get to work. She would yell at you and throw things for the smallest of mistakes, hell there were times she would do it when it wasn't even your fault! We all swore she must be bi-polar because she would scream one minute and be laughing and friendly the next.
So I finally find my escape and land a new job. More money, more responsibility and far from the wretched woman. I didn't give 2 weeks notice because the new job wants me to start right away, and quite frankly there's nothing to train someone else for. So first she calls me to ask me to send her back my almost finished Metrocard. (we had Transitchek). I say fine. Then she goes on about why did I not give her 2 weeks notice. I told her maybe if she was not so condescending and was more open to ideas, I would have given her the courtesy. She then says she will be docking my last paycheck because since I did not give 2 weeks notice, I made myself into a temp, and she does not pay temps sick pay or holiday pay. (I had taken off maybe 2 days)
I told her that's against the law, and she said "so sue me then".
This happened a few hours ago. I am tempted to report the Metrocard stolen and then mail it back to her and then have my lawyer friend send her a nice little letter.
What say you??

First I would write the company a legalish sounding letter that would be quoting Department of Labor law for your state. If you need help, FM the state.
Then even if she paid me, I would be filing a complaint with Department of Labor.
eta. Nothing like that every happened to me but it did happen to our employee at his old company. I drafted an email quoting PA DOL law. He got his check.

I would definately have your lawyer friend writer her a nice little letter. Sounds like she needs a reality check. It is not the law to give 2 weeks notice. It's a courtesy, and it doesn't sound like she deserves that courtesy.

I should probably also mention....
She might also be ticked because I resigned via post it note on my desk. Kind of like that Sharpie commercial.
That goes to show you how much I cared about working there. Although I have managed to give my old co-workers and some friends a laugh by telling them how I quit.

Doesn't matter how you quit (although it is amusing), they can't touch deduct anything from your wages that you've earned unless they have written permission from you.
The Department of Labor requires you to have asked for your wages before they will work on your behalf. Not sure if you're in NY but...
Source: NYS DOL website The Commissioner of Labor is authorized to institute criminal proceedings for failure to pay wages. The Commissioner of Labor may also require an employer to pay interest and civil penalties on unpaid wages. The Commissioner also may take an assignment of the employee's wage claim and may institute a civil suit to recover the wages due. Where civil action is brought to recover unpaid wages and the failure to pay wages is found to be willful, the employer may be required to pay an additional amount of 25 percent of the claim in liquidated damages.
