Seller attending closing?
I called my lawyer but she hasn't gotten back to me yet--
As a seller (with a mortgage), do I have to attend closing of my property? We've finally been given a closing date, but I'll possibly be out of town for work, and I really don't want to reschedule the closing. I need it done!

hmmmm. I am curious of this. I thought I saw on here that you didn't have to be there. When we closed on this house the seller was there.

I know they CAN be there, and I would be if I could. However since I have a previous commitment I wanted to know if there was a way it can get done without me!

Re: Seller attending closing?
For the most part, your attorney can represent you.
I say for the most part only because the banking/lending environment is so volatile that I wouldn't be surprised if the bank give some resistence to this.

Re: Seller attending closing?
I've closed with 3 houses; 1 as a seller and 2 as the buyer. As the buyer, the seller was present at both when I closed. As the seller, I was also at the closing. I am under the impression that it is the norm for the sellers to be at closing, whether attending themselves or sending someone through POA to represent them.

My neighbors sold last yr & were already living out of state. Their lawyer closed for them. You can give anyone POA to close for you.

Re: Seller attending closing?
Our seller moved OOS and was not there. Just the lawyer.

Re: Seller attending closing?
The seller to our house didn't come. The attorney had the power to sign all docs. He did make a few calls during the meeting and it went smooth

Re: Seller attending closing?
Alot of the times the seller pre signs everything and has a Power of attorney.

Re: Seller attending closing?
You can pre-sign everything and just have your lawyer attend. this was presented as an option to us when closing on my moms house, because my brother had midterms that week and was unable to attend.

You can give someone Power of Attorney or give it to your attorney

The sellers were present at our closing, but I'm not sure if it's required.

The seller was not at our closing. They had moved OOS months earlier.
