Fighting a speeding ticket?
Has anyone every been successful in fighting a speeding ticket?
On friday night, dh, ds and I got frozen yogurt. About 1/3 of a mile into the drive home, dh got pulled over for going 42mph in a25 mph zone. But theres no way he was going that fast. I was in the car with him, and we were behind a slow moving truck. Also, DH never speeds. I always joke with him that I should drive because we will never get to where we are going if he drives. If I was driving, then I probably would be guilty as charged, since i tend to speed. He has a clean driving record in the 14 years he has been driving. He has never gotten a ticket or has ever been pulled over. But it's the cops word against ours.
Sucky part is we just moved to NC ( like 2 months) ago, and going over 15 mph over the posted speed limit can get you 6 points.

Fighting a speeding ticket?
I have only been pulled over once (knock on wood) and it was for speeding. I fought it and it was reduced so I got less points but still had to pay the fine.
It may be different in NC though.

You can go to court and hope the cop doesn't show up. I think they have two or three times to make it, otherwise the ticket is dropped. I got away with this twice in my younger days lol

I would definitely try to fight it, at least to get the points reduced - it can't hurt to try and see what they do. Usually (at least in NY), if someone has a clean record, they'll be pretty lenient and reduce it substantially

I;ve always been successful in getting the charge dropped significantly (both times with an attorney).

Nc is no joke with speeding tickets, just pay it you will lose if you go to court. I know this, because my brother got 5 the first 6 months he lived there. Went to court three times, lost all 3.
Eta:2 of his tickets were in his own development.

Hard to say, because what applies here in NY can be very different from what applies in NC where you are .

I would definitely go to court. We live in NC as well and DH has gotten a speeding ticket reduced by asking for a Prayer for Judgement or PJC.

I love this whole "cop not showing up" stuff. DH was a cop and it wasn't OPTIONAL to go to court. If someone was fighting a ticket you wrote and you got a notification to go to court- you HAD to show up- unless it was on your vacation. If you didn't, there wuold be major consequences.
Why would any cop show up to court if they didn't have to? It's not an "if you feel like showing up" thing. It's ordered.
Whenver I say this to DH he says- I want to know what PD this is- because in NYPD- that's not happening!

Ask for a supporting deposition and if the police officer does not provide in within the prescribed time, you can make a motion to dismiss. You should be able to find informaiton online about how that works in NY. I don't think that this is as easy as it once was but it is a generally under utilized technique. I used to do this for several people and I was amazed that more people did not know about it.
Oh, the ticket itself was in NC? There probably is not a similar rule but I will leave my post up for anyone in NY who gets a ticket.
