I'm so sorry your little girl has to deal with this. Good for you for being so proactive ! Nothing gets done when you aren't. I must say, I feel sorry for the instigator too because she is obviously being raised by people who've never taught her empathy or limits. I'm sure this will be the first of many incidents she is involved in.
ITA. While, I feel HORRIBLE for your DD, I also feel for the other little girl.

I'm sorry, I may be in the minority, but this is what, a 5 year old? Yes she is out of control and needs some SERIOUS discipline, but to have her expelled from school? That's taking it one step further than id feel comfortable.
Clearly there is something going on with her that should be addressed, but insisting on having a sexual assault on her school record is a little over the top IMO.
I don't want to minimize what happened to AJ, it was terrible. This girl sounds like a nasty brat and deserves so very serious punishment. I'm so sorry for what your daughter is going through.

It's harassment, wth does her parents donate money to this school? She should be minimum expelled and counseled so see what is going on.
My SS was almost suspended for scratching himself at 7 - the thought he was touching himself. The only reason he didnt, is because we explained that he had bad eczema. Obviously we had to talk to him and let him know that he would have to excuse himself. But my point is touching someone else has to be cause for some type of action. School is suppose to be a safe place for your daughter.
Actually, something similiar like this happened to my niece where she was getting bullied by a girl for the whole year and then the last straw was the girl touching her inappropriately. My sister had several meetings with the school, school and parents. They didn't handle it well, so my sister pulled her out. It was when my niece was in K and in a charter school.

ETA: Im willing to take sexual assault off the table but assault it still is and its bullying and its not the first or second time. Yes its extreme to expel her but perhaps that's the wake up call this brat and her parents need? Perhaps a sit down with a man in uniform may cause the parents to realize they need a stronger approach and to stop buying into the tears. And lastly, a report may do none of that but its going to be on her record. Next child she does this to, it will pop again. It will be on city file for minors. CPS will have a copy. How many children need to suffer for this little brat? Not mine!

I see where you are coming from and would agree if some action had taken place, but the school hasn't done anything at all. After the first few incidences some action should have been taken, then if she didn't start behaving have her expelled for doing the last thing. This is multiple acts of bad behavior over time.
My major issue and wtf is with the parents and school, not so much the little girl. Also as innocent as it can be,imo touching privates is very serious.

My DH is my voice of reason as well, when I am emotional about something - it's like I got shot out of a cannon. DH will reign me in if necessary. lol

Ok I def see where you're coming from. 7 yrs old is also much different that 5 yrs old so now I'm more with you on the whole assault thing because a 7yr old should know better.
I still feel, however, that much of this is the schools fault, and I think I would be directing my rage at them. This girl could be inherently mean and nasty, or she just desperately needs some discipline and guidance. Maybe if proper interventions occurred months ago, the most recent incidents would not have occurred. Either way, your daughter paid the price and something needs to be done. I hope they figure out a way to make sure this never happens again and that little girl stays the hell away from yours .

I doubt that a 7 year was kicking the crotch for sexual reasons. She probably just realized that it would be a painful place to strike. Can you request that this child be removed from your daughter's class ? That they have no contact at lunch, recess, after care etc? I would love it if this incidents was a wake up for the little girl's parents and led them to get therapy and question some of the parental choices they have made. It would be in the public interest for this child to get help now so she doesn't become a complete menace in a few years.

Someone should see what is going on her home,has she been touched in appropriately or seen something she shouldn't ? Not normal behavior for a child that age.

I'm not saying what you should do but I have never ever heard that sexual assault needs to be associated with arousal and I am a teacher. I think that's some bs they are stringing. I'm not saying she should be expelled or shouldn't but I think the district is full of it.

I kinda agree with his too. Sounds like that whole family needs some serious couseling. Real deal behavior intervention and being evaluated by a psychiatrist probably would not be a bad idea either. The problems will continue unless the real true reason is pinpointed and fixed. Just being suspended, expelled, or changing classes is not going to change this girl's behavior. If not your daughter it will be someone else.
Not that this should be ignored, but it sounds like this girl is doing these things to get attention and she is pushing the limits to makes sure she gets it in any way, shape , or form.

I agree! And how would the district be able to decide that anyway?? When none of the administrators saw the incident I'm sure. Touching is touching and it is WRONG no matter what the child's intent was at the time.

Update Friday Morning: She has a 'consequence' due to this event. She has been spoken with a counselor.
I informed the principal I want this child out of my daughter's class to provide further distance from any future event that may result in serious injury.
She said she'd have to get back to me (I doubt).
Key words/phrases used: Repeat offender Physical harm Bullying Followed the rules and reported Lack of communication Resolution needs to insure my daughter's safety
My hubby and I are at this point: Take her out of our daughter's class at my request. - I am at this point.
If taken out of her class, I will let this be handled by them but understand the next time, I will call in the cops.
If they say no, then I want her parents to know we've requested a resolution of her moving out of my daughter's class *OR* we can contact the authorities so that if she remains in my daughter's class we can have a record of this incident and the incidents in the past. This will at least insure that should she harm our child again in her class that the authorities will have the 'full story'. This gives HER parents the chance to formally request her taken out of my daughter's class and avoid the cop call.

I don't think I would argue sexual assault, just assault. A seven year old should know not to touch anyone else in their private parts. I feel absolutely horrible for AJ but I also feel that some kind of intervention needs to happen for the other child too. If the school is falling down on its responsibility, and clearly the parents have failed this kid too, then I would go to the police where hopefully something can be done before it gets worse. The school policy clearly spells out it should be doing something in this instance. They had their opportunity and failed. You only get one shot to do the right thing the first time. And now it is up to the parent to make the school to do the right thing. My first instinct is to protect my kid. If the school is failing to do its job then, I would seek out additional resources to make sure that my kid and all kids receive the help they need.

so frustrating. I would demand the child be moved to another class. IF they refuse then ok, guess the assault has to be reported to the police because who knows what kind of records they will keep. The idea that the child grabbed at that area, would be cause for concern they are picking up something from home.
