Condo = questions for me

So we are in contract waiting on a closing date etc

this is all new to me
The Seller asked if we wanted to come in and see if there was anything we wanted since they were down sizing and were going to throw our and donate

I was all excited, then dawned on me- I want it all out

They have a bedroom set in the master bedroom that is attached to the wall- To me if its removed the wall needs to be repaired and patched up

What should be or not be left?
should the condo be completely bare if we chose to ?

Yes it should be empty. Same with a house. Everything should be detached and moved out. I would tell her that you would like the place empty. You can have your attorney make this required too, it could be in the contract you want the condo empty upon move except if you do decide to keep anything. I always think it is best to have everything in writing.

Usually contracts require properties to be "vacant and broom swept" at closing, which would mean that all personal belongings, furniture, etc of the previous owners would be gone. If there are items the sellers don't want, they are responsible for removing them/disposing of them. It's common for sellers to ask buyers if they want them yo leave anything, as it saves them the trouble/cost of getting rid of big items they dint want or need.

However, built in furniture is typically considered a fixture that would stay with the property (along with appliances, light fixtures/chandeliers, kitchen cabinets, etc). The sellers would not typically be responsible for removing a built in bedroom set and repairing resulting damage to a wall unless that was specified in the contract (and it doesn't sound like this issue came up or was negotiated). So I think you are out if luck with the bedroom set - if you want it gone, you will likely have to deal with it yourself.

Are you sure it's built in/attached? Sometimes it's hard to tell. You can always ask the seller to clarify whether it's a built in and whether they plan to take it down (or would be willing to).
