Leaving job - question re: vacation time

I am a 12 month employee that works in a school. Our year is July 1 to June 30, so every July 1 we received all our vacation, sick, and personal days.

I am leaving the district (for another) on 7/20. I took 4 vacation days 7/5-8 and I'm being told they will be without pay (pay day is 7/22). The contract (I am a CSEA employee) only specifies "should any employee "owe" sick leave, it is understood that these days must be repaid to the district."

Am I right is saying that I am entitled to the vacation days and I should b paid for the time I took off?

Although you receive all your sick, vacation and personal days at the beginning of the year (7/1), you still have to earn them based on the company’s rate. It’s usually something like 1 or 1.5 days every month or a certain amount per pay check. Your total days would be prorated throughout the full year based on that.
You only worked July 1 – July 20. The earned days for the 20 days in July most likely is not enough time to earn 4 days.

Check your handbook and see how you earn the days.

We do not have a handbook, just a contract.

For vacation, it does not spell out that they days are accrued. It says you get X # of days per years of service.

For sick, it says days are accrued at a rate of 1 per month and if you leave prior to full year, you pay back

No, you would not get paid for those days. Agree with the other poster - just because you "receive" your days on 7/1 they aren't earned yet. You're expecting them to essentially "pay" you (via vacation time) for a year you haven't yet worked.

I think it depends. Did you get vacation days in your first year? If not, then technically the days you received were earned in the prior year (this is how my last job did it, you only had vacation in year 2).

Our days are earned as well. You can take them at whatever point during the year but, if you leave and haven't technically earned them yet - it gets taken out of your pay.

It depends. Some policies are that you earn days and then no you would not get paid for the days unless you were there long enough to earn them.

Other places just give you the allotted amount and you use as you want. Then yes you would get paid for them.

I have worked at both types of places.

This is my interpretation

Also, I spoke with my Union President and she said only sick is earned & would need to be paid back.

I'm waiting to speak with the Superintendent
