Giving 2 weeks noticed while on paternity leave?
So DH is switching jobs but we are also expecting our first child (talk about timing lol). Here is the situation. He is planning to take 2 weeks paternity leave but if baby arrive late by the time he comes back he will be less than 2 weeks before he have to start on the new job. Should he go back to work early so he can give his 2 week noticed or can he give his noticed while out? . He wants to leave his current job in good stand but also want to enjoy as much time with the baby

I would give the notice prior to the leave and see if the company wants him to come back or will allow the leave (or make the decision to put the notice in and take the time with the baby unpaid before starting the new position)

If he put the noticed before the leave and they don’t allow the leave he will loose his pay time off and over a month of income we can afford that :/

Many companies require you to come back after leave, so he would need to be back for a day and then say I am leaving, but honestly, any way he does that will not let him leave on good terms. He will be screwing over his former employer. So he can either say, I am putting in my two weeks, which they will likely fire him on the spot, or take the two weeks paternity, come back and then say it, and he will also be told to leave. I would do what is best for you.

Giving 2 weeks notice in no way guarantees that they won't walk him, regardless if he gives it before or after the baby.
If he has a good rapport with his direct boss, he should discuss it with them. Get in front of it and approach it from the place of, "the timing on all of this isn't the best but I want to make sure that we can put a plan in place to make sure the transition is smooth for everyone." That puts the onus on the boss to decide how to handle it. Unfortunately, bosses and companies don't often act the way you think they should or what's best for the team but that's the way it is sometimes.

I do not think it is fair to expect the company to give you a full month of paid leave and then not come back and finish out your two weeks. Sorry -- stinks that the timing isnt better. If it makes you feel better most companies have never given paternal leave (prior to 2018). I husband was given one day for the birth. Anything additional was his PTO.

My job required I came back for 30 days or I had to pay back. Make sure he reads up on the policy before making any decisions

Then he should just start his new job right away.
Coming on here and asking how to be deceitful to his current job but still leave on good terms is kind of an oxymoron.

Wow ladies he is not trying to be deceitful in any way shape or form so don’t assume stuff. His paternity leave is not paid he will be using his pto so he is not trying to abuse the system just use his time off if possible. If baby is born beginning of February he can take 2 weeks off (using his pto). He will go back to work mid February and put 2 weeks noticed. His new job start beginning of March. His concern is if baby come late should he put his time off before go on leave and be concern that they walk him out (meaning not working until March), go back to work earlier than the 2 weeks to make sure he give his proper 2 weeks noticed or Can he give noticed while he is out on pto.

Please tell me where i said i wanted do something deceitful. I have seen discussion of moms coming back from maternity leave and putting their notice because they decide they wanted to stay home so that’s the only reason why i posted here to make sure he do it correctly

FWIW it doesn't sound like you are trying to be deceitful, but I also think it won't leave your DH and his company on good terms if he gives notice while on leave, PTO or not. I'd hope the baby comes on time or come back a couple days early if baby is late.
