FMLA OR PAID FAMILY LEAVE- will get fast answer here!
Can more then one family member apply and use either FMLA or PFL for the same person? Example: MIL diagnosed with cancer can myself, my husband and FIL all apply for FMLA to care for her? I’m calling my HR dept today but the likelihood of getting an answer is slim!

I don't know if it's company specific, or general to to FMLA, but you can't take FMLA for an in-law. I think you can take PFL, however. And, as long as you don't all work for the same company, you definitely all could take FMLA for the same person. There's no way they would even know that someone else is taking it too.

I believe that FMLA only covers your immediate family (your own parents, spouse, child, or yourself, not in-laws) You might have better luck with PFL, for I think that they cover inlaws.

FMLA does not cover inlaws.
NYS PFL does.
And of course you can all take off to care for the same person.

can someone explain why one would take FMLA (unpaid) over PFL? I am debating staring the paperwork for myself to take care of my young daughter who is going through a lot medically - my job offers both but I cant seem to get a straight answer from them

Hi, PFL is paid while FMLA is unpaid so that would be the difference in determining which one you should take. Also, PFL doesn't offer job protection while FMLA does. I hope this helps!

In this case, you would be entitled to leave under both FMLA and PFL, but the leaves would run concurrently. It's not a matter of picking one or the other. If your PFL qualifies under the FMLA, you will be using both FMLA time (unpaid 12 weeks) at the same time you are using your PFL. You cannot pick one or the other.

FMLA is not necessarily entirely unpaid. It would depend on your employer's policies (for my employer, it depends on how long you have worked here as to how long they will pay your full salary).

Thank you! I did some research and saw PFL can be used for in laws! Myself, my husband and BIL all work in different state agencies so I guess that will have to be answered by my HR., just trying to get my ducks in a row! Thanks everyone!
