HR (FMLA)
Hi guys
I have a quick question... I am due to have surgery next month and my husband asked for FMLA from his job and today he got a letter in the mail stating that they denied it because of staff.
my question is
Can they do that? He has been there for over 6 years He did take four weeks early this year due to my first surgery.. I know that with FMLA you can take up to 12 weeks a year...
the letter was signed by his boss and HR. The funny thing is that they never even asked for a letter from the doctor. Right now we live in two different states so, him taking off for 4 weeks is nessary
What can we do?

Based on what you have posted, they cannot deny him FMLA.

If he's entitled to it, the company cannot deny him FMLA.
