NYC DOE child care leave

I was given some incorrect information. But I was hoping someone had a definitive answer for this.

When you have a child you can take a leave for ONE YEAR and RETURN TO YOUR SCHOOL.

After that you have a job but can get bumped from your school.

Is this correct? Are you guaranteed your school for one year?

My understanding is that as long as the position still exists and you have seniority over someone else holding it you get the position no matter how long it's been.

I am not sure. I know you are def in the same district. Usually you get your school cuz unless you were just hired you would be higher than someone seniority wise. You may not get your same position/classroom. I have been on childcare leave for 3 years, and that is how it was explained to me.

What you said in the OP was how I took to understand it..I actually understood it as even if you take the full leave, you have a position at your school unless you are in an excess position (more seniority than you exists) since your time accrued freezes when you go out...

Sorry to hijack, but I've got the same issue. I was under the impression that I was entitled to go back to my school. The person that was hired to replace me had less time (in the building and in the system), but will have caught up in system seniority by the time I return in Sept 2013. I was the only guidance counselor in the school, so I know my position will still exist. Will I be stuck in ATR Hell when I go back?

The UFT gave a friend of mine wrong info and I'm a little scared to call them.

R- this is where there is an issue. Even though the "position" is still there if the person occupying it has more DOE seniority you cannot claim the spot. Building seniority does not exist. I was under the impression it did, but as you know I learned it does not.

My curiosity is about the first year, is that a freebie, I know my Principal had it filled with and ATR and called it a "leave replacement" whereas when I was going to take this upcoming year (2nd year out) she called it a vacancy.

Well, you were the friend I was talking about. Now I wonder if I call the UFT b/c I don't know if the answer I get is going to be correct.

I have a similar story. My principal hired an ATR to replace me for the remainder of the school year after DD was born. Then I took off this whole year. And now since I'm taking next year for Baby M2, I have a feeling I'm going to be screwed.

Anyone know for sure?

I would call your district rep and find out. If your principal posted a position for a vacancy find out if it is an appointed position bc that means the person will have a spot in your school and no longer a leave position or atr
