Re: TOB Permit for fence and retaining wall - help

I am not in that township, but from past experience it is not more expensive, you just pay what ever the permit would have been and they come out and look at it.

In my township (I'm in NJ), a retaining wall must be 3 feet from the proptery line and then the fence has to be 18 inches from that. So when we built our retaining wall, it was done to code but we didn't file a permit. Our property line is 5ft. past where our fence in the back.

I would call, only because you had have a neighbor that already brought it up.

I would wait until you get a notice from the town. As of now, you haven't gotten one. Your neighbor did, but it's not like they can prove she told you about this or you even know it's an issue.

It may slip through the cracks or it may take awhile. I'd rather deal with the issue if and when it comes.

If you are not in compliance with a town code/rule, it's not like you get fined, you just get a notice of violation that you need to correct it. At that time, you can apply for a permit (if you need one), or if you are not in line with current code, a variance, or you can remove the structure/improvement that's in violation.
