Official: Capsized boat had enough life jackets
Updated 8/8/12: A cabin cruiser that capsized July 4, killing three children on board, appears on preliminary inspection to have been mechanically and structurally sound, a source with knowledge of the investigation said. There also were enough life jackets on board for all the passengers, the source said this week.
The finding is the first to become known since the investigation began more than a month ago. The source said further testing on the boat is still needed. Investigators continue to interview witnesses, and are waiting for more complete information on the boat and the events leading up to the tragedy, the source said.
Lawyers for both the boat owner and the boat's driver have said that their clients had yet to be interviewed by police since the night of the tragedy.
Nassau County District Attorney Kathleen Rice and Nassau police both declined to comment, except to say the investigation is ongoing.
Last month, investigators said initial interviews appeared to indicate there was a strong possibility that the vessel did not have the legally required number of life jackets aboard, a police spokesman said at the time.
Nassau police indicated that the main focus of their investigation was whether the boat was overcrowded when vessels were departing the area after a fireworks show had concluded. Officials said they are trying to determine if wakes from other boats, stormy weather or mechanical failure also played a role.
The 34-foot Silverton cruiser, named Kandi Won, had 27 people onboard, at least 10 of them children, when it capsized near the mouth of Oyster Bay on the way back to Huntington after a fireworks display.
Three children trapped in the cabin died: cousins David Aureliano, 12, and Harlie Treanor, 11, and family friend Victoria Gaines, 7.
Sal Aureliano, David's uncle, has said he was steering the boat when it hit a large wake that he did not see.
Many marine-safety experts and other boaters have speculated that the cause of the accident was overcrowding, a charge that James Mercante, a Manhattan lawyer for the boat's owner, Kevin Treanor, has denied.
Mercante said Monday he and his client have not had access to the vessel since the accident and he cannot comment on its soundness. He said he was not surprised to hear that investigators had found that there were enough life jackets on board, since that's what Treanor, Harlie's father, said from the start. Anthony La Pinta, who represents Sal Aureliano, declined to comment.
Tuesday, Suffolk County Legis. Steve Stern (D-Huntington) was to introduce a bill that would require all boaters to take a safety training course or face fines and even jail time for repeat offenses.
Stern said his bill would take effect one year after being passed by the legislature, if that happens, and signed by county Executive Steve Bellone, who endorses the legislation. Stern said he hopes to have a vote by the full legislature by early September.
Wednesday, Lisa and Paul Gaines, of Huntington, Victoria's parents, are scheduled to testify before state Sen. Carl L. Marcellino (R-Syosset) and the Standing Committee on Investigations and Government Operations.
Other speakers include state parks Commissioner Rose Harvey; Sgt. John Owen, deputy commanding officer of the Nassau County Police Marine Bureau; Lawrence Postel, district commander for the U.S. Power Squadrons boating safety organization; Chris Squeri, executive director of the New York Marine Trades Association, and Jackie Martin, commodore of the Greater Huntington Council of Yacht & Boating Clubs.

A spokesman for the Nassau County Police Department confirmed to WCBS that three people from the vessel had died. It was not immediately clear whether one of the fatalities was an individual hospitalized earlier in serious condition after being rescued. The ages and identities of the victims were not released.
The newspaper Newsday reported earlier that children may have been among those missing before the search was ended. Police did not confirm this.

What really hit me was the quotes in Newsday. I cannot imagine being able to leave if my kids weren't found yet..
From Newsday.com: One nearby boater said he saw the Silverton yacht turn right, then tip over after it was hit by a wake.
"It was like in slow motion," Sammy Balasso of Oyster Bay recounted. "All of a sudden, a lot of bodies were in the water."
In the "pitch black" night, Balasso said, he shone his 38-foot speedboat's spotlight on the Silverton and threw every life jacket he had in the water. He got 20 people onto his boat and police vessels later came to take some of the survivors from his boat to shore, he said. "Everybody was panicking," Balasso said. "People were saying things like 'Why?' "
Some also yelled the names of two people who were missing, while others hung onto the top of the capsized boat, he said: "I don't think they wanted to leave whoever they were looking for." Authorities on the scene said there were reports that a 7-year-old girl and a 12-year-old child were among the missing. There were several children and young teens known to be on the boat.

This is so sad. I'm not trying to place blame but isn't that a lot of people to be on a boat that size? Did they have enough life jackets for everyone?

The toddler drowning in Islip also got to me yesterday.
My family had JUST been discussing the topic of having a pool around little kids when I saw the alert come to my phone.

This is just terrible and I haven't been able to sleep all night as an avid boater, who frequented that area many many times on our boat. We were discussing yesterday how capacity on my 30 ft boat is 8 adults. Could it fit more? Sure? 27 people on a 34 foot boat? Probably exceeds capacity. I also don't know how a captain could put more people on a boat than life jackets, like reported especially for the children.This is a tragedy.

I am disgusted by this story.
27 people on the 34 foot boat?????????????????
We have a 28 foot boot, and anymore than 6 or 7 people we are bumping into each other.
I read that this is an "experienced boater"....an experienced boater would know thats too many people and that kids need life jackets no matter what.

We also have a 32 foot and I cannot even imagine where 27 people would stand or sit. So sad for those poor kids who had to suffer because of the poor judgement of adults.

ITA... I'm saddened at the loss of life...
but any "experienced boater" would never, ever put that many people on that size boat. My father has a 52' boat and wouldn't put that many people on it.
It is disgusting.

Same here! My DH had literally just said, we are not getting anything bigger than a kiddie pool. Two seconds later I got the alert on my phone. My heart sank. I told him, "You're right! No pool for us".
These stories are just so sad! I can't even imagine what these poor families are going through.

This is a prime example of poor judgement on part of the parents and putting their needs above the safety of their kids.
There is no way in hell I would have gotten on a boat with this amount of people much less taken my kids with me...plus they didn't have enough life jackets.
Lord have mercy on the souls of those poor innocent children...someone should have been watching out for them

Please keep the family in your prayers. I'm getting word from friends who know the family and it was 3 children, ages 8, 11 and 12 who died.
I just dropped my kids off at their summer rec camp in Oyster Bay and you can't even get near the marina, there are news trucks all over, and helicopters circling so low I can see the pilot in it!

I agree. My dad is an avid boater and has a 50+ footer and wouldn't have more than 10 on his boat, and all the kids MUST wear life jackets.
That is his area and he was there last night for the fireworks. We are away so didn't join him this year but he told us this story. The kids weren't wearing life jackets.

This story is so horrible, the boat owner was being reckless by letting that many people on his boat, especially for this event.
We were there last night but we left as the finale started like we always do to get ahead of the crowd. It is just too scary for us otherwise. All of the boats that are crammed into one space for the fireworks go full speed in a million different directions to get home. The water gets very choppy as a result and I guess that is how this boat got capsized. Those poor children, someone should have been looking out for them, this could have been prevented.

It is so horrible that a tragedy like this occurred! In it's event, I would hate to cast blame, but it is disgusting to have had so many on the boat!
