A little TTC related-kinda personal to me-Re-Disability
I wanted to post this here, maybe someone could help me.
As everyone surely knows, I am not doing well health wise. Why I say this is somewhat TTC related is because I know that my conditions, if out of control, may prevent my BFP.
Basically I am an uncontrolled RA patient with a flare that has lasted now over 3 months (hello joint damage). I also have back issues that we do not yet know if they are separate and apart completely from my RA or aggravated by them (I am having severe, almost immobilizing back pain and still here at work-trooper I am).
Long story short-my doctor does not think it would be a bad idea to go out on disability for the short term (I do want to work again at some point, but I am really at the point where I just feel like my body is breaking), but I absolutely cannot bring this up to my superiors in fear of them using it to fire me.
How do I go about this? I need medical coverage (I am the one that carries the benefits and I would need to obtain major medical treatment out of work).
I am lost!

Can they fire you if you go out on disability? Don't they have to wait a certain amount of time?

i "think" its the doctors call to put you on disability.. like he has to give you papers and such .. i am trying to remember the protocol when i worked for the doctor..

i BELIEVE that disability is a doctor required thing and NO company can fight that (until, as Ryan suggested, a certain amount of time passes).
How it worked for me....(i had spinal surgery 3 years ago...and it was NJ...but i'm sure it's at least SIMILAR).
I had the surgery and was out on disability for a month. My job got the papers from the doc and surgeon(in my case) and my job was 100% safe for a certain amount of time. They didn't have to keep MY specific job, but one that i could come back to (if you worked in a school let's say - they don't have to keep your class, but you would HAVE to be able to come back as a teacher).
It's the same thing with maternity leave actually...you are SAFE while you are out - they CANNOT fire you.
i hope you feel better hon...if you feel as if you are breaking, time off to get well may be the single best thing you can do for yourself...

I want to say they didn't pay me - but the state did - i could be wrong...but my salary might've taken a small hit (again, i don't 100% remember) and my insurance was 100% what it was prior...
Also wanted to let you know - i got injured less than 3 months after being with the company...i had surgery when i was with them for 6 months...so the 'time in' at a company DOES NOT MATTER...

There is a number on here you can call.
I don't think the pay out is much per week, but I could be wrong. I remember girls on maternity leave complaining that it pays barely anything.

If your job offers short term disability that would probably be more $. You should contact your HR rep.

Thanks! They actually do. I found out from a co-worker that went out on it. I just need to get the paperwork.

If you go out on short term dis. i believe they cannot fire you..wouldnt that be illegal?
disability comes out of your paycheck..if you need to go out, then i believe its your dr. that needs to get you the paperwork.

You are right. Thanks! I believe that I need to contact HR to figure this one out, but I don't want to even hint at it until I am on my cell phone at the doctor's office.

good!! make sure the bases are covered.
my good friend had heart problems that kept her out of work for weeks on end. She used her vacay and sick time by the time she had open heart surgery in oct of 2007. She used FMLA leave and was recuperating. Her dr's cleared her to go back to work as of 12/7. So for 2 weeks she was trying to get H/R to get the paper work ready and touch base with them. they're a bunch of a$$holes the h/r pple we worked with.
I think it was 12/1 of 07 that they informed her they were replacing her with the temp they hired for her. UNREAL...GIRL GAVE 8YRS OF HER LIFE, suffered so much stress between 2 take overs (i left after the first one) and they do that to her.
So make sure your doctor is on board with whatever decisions, gets everything in order to protect yourself.
although FmlA leave is different from disability..b/c with FMLA leave the minute it is up, they are not obligated to hold your job anymore.
write everything down..keep every piece of paper, and if your job has an h/r binder or employee handbook..dig it out and be up to date on all their policies.
never hurts to be prepared. but your a lawyer..so im sure you know all this..LOL

I am keeping ALL documentation. I also document every negative comment made towards my disability.
I think I am going to call an employment lawyer to discuss this. I live by the mantra-The lawyer who represents themselves has a fool for a client!
