Well, technically, unless they officially release you from your lease they can just let the apartment sit vacant for the remainder of your lease and then sue you for the rent for each month left.



I was told this is illegal. they have to actively find a renter.



whomever told you that is wrong... in some states that is the case, but in NY there is no duty to mitigate.



that stinks. I guess I will speak with management. I am more than willing to lose security and pay 2 months rwnt. Iwould just like to leave. I am very unhappy.

At Fairfield.....you might as well give up your newborn child.




This is so true. I had a HORRIBLE experience at a Fairfield.

Basically we wanted to break our lease for a few reasons, the people below us smoked in their unit and every morning our living room and bathroom smelled of cigarettes. The heat never worked in the winter, our unit would never be over 62 degrees. The people next to us would blast OFFENSIVE music at random times throughout the night and then there was literally an army of stray cats on the property and we couldn't even walk our dog at night because there were two cats that would attack you. Oh and then the neighbor's kids would knock on our door over and over again to make our dog nuts and then run away... and then the neighbor would compain that our dog was barking. Fairfield's response to all of these things was that there was nothing they could do.

So we started looking for a house and when we found something we basically we turned in our keys, told them we were moving out and that was that. They kept our security deposit (which we expected) but never came after us for anything else. They had said they could sue us for the balance of our lease (7 months), they never did, I am sure they rented it pretty quickly since there was always a waiting list.

I'm in Fairfield and I've heard the same, though they've been GREAT with us so far.

Last year we were supposed to close on our house June 1st. Our lease was up June 1st. We didn't close, so I had to extend my lease month to month, but at a really high premium. In the end we had to resign because we had to walk away from the house, but they were great about letting us resign at our lower price, etc. My neighbor is a Fairfield leasing agent and said they never let people do that. When we close on our new house (hopefully this month) I plan to just turn in my keys and be done. They can keep my deposit. There are PLENTY of people who will rent, there's certainly no shortage. Any vacant unit gets snapped up in my complex.

bump for new question.

I would like to write a letter expressing why I would like to get out of my lease. any idea what to write?? I clearly cant write bc I hate the management. if I write we cant afford it anymore how can I word it?? thanks



Again, I think your best bet is being upfront...I am moving on this date..put my apartment on notice, and try to re-rent...see what they say. You have to then put it in writing, but not that you can't afford it. Do they have a job-loss clause in their lease? That is typically the only way you could get out..but you would need a letter stating that you or roomate/SO/spouse lost their job? Then you would be out. Not sure if that is the case, or if you could "make it the case".

This is nearing the prime rental months..see what they say, and you may not have anything to worry about.

This isn't always true, and just be careful. If it is before your lease expires..they can certainly hold you to it. I would give them as much notice as possible, (60 days) or let them start trying to re-rent it. You are lucky, because at tax time, the spring approaching, schools letting out for summer..it is a prime time for people to look. I would tell them ASAP. I have seen the nicest of people get so screwed!
