benefits q- sick time before baby is born?
Anyone know if you take sick time before your baby is born, does that count towards disability? I know i have to call my disability provider once the baby is born, but I have 10 sick days and I have to use them before August 31 or I lose them, and I am due August 20th. I am thinking of just staying once I reach my due date and just use my sick time, but I am not sure if that counts towards disability once you stop working.. my HR rep was very vague when I asked her, she just said "if you are sick then use your sick time". TIA!

I think one off's don't dont wount toward FMLA.. and it may depend on the reason you are sick. Im not 100% sure though. You're HR rep needs to clarify it for you.

There are three pieces to this. FMLA and short term diability are the first two (STD is usually through a carrier like Cigna, Aetna etc.) and the clock doesn't start until the date your doctor fills out on the FMLA paperwork (form WH-380) which is usually the same date you give to your disability provider when you call to make the claim. Any sick time you take before that will just come from the bank of time your employer provides to all employees for sick time and not count against the 12 weeks of FMLA you are entitled to or any of the days you are given through short term disability which is 6 weeks for a vaginal/"traditional" birth or 8 weeks for a c-section.
(I work in HR and handle benefits as part of my job )

When I was preggo with DD#1, the company I worked for took all of your sick days for an entire year before you gave birth (yes, that's right BEFORE you were even preggo) and took them off of your paid maternity leave. I was so pizzed! I think legally they could do it because they were paying my full salary for 6 weeks.

Companies can do that with vacation and sick time if they are paying you in part with salary continuation but I think her situation is different since her sick time expires mid August.

I would also ask your HR people if they could let you keep your sick time since you're due around that time. Our HR people made an exception for my coworker since she was due in August and had an extra week and our use it or lose it vacation days end June 30. Doesnt hurt to ask

I think you should ask HR..there seems to be slight differences depending on your company.
My company gives you 6 weeks or up until you get a MD's clearance for both a vaginal or c-section birth. The first 6 weeks is treated as short term disability, i have to use 5 days of PTO time then i get 60% of my salary. Then they offer "bonding" time for an additional 6 months after MD clearance. Bonding time is covered under FMLA but that of course is without pay. My HR dept told me i can use PTO time during my bonding time instead of using it without pay but i dont think i would do that. I can see myself needing PTO time after i come back to work because it will still be the beginning of the year.

They can use it against you if you combine it with the leave. I would start taking a day here and there to use up your time, prior to the leave.

Agreed. In my job (NYC guidance counselor) any time I took off before the birth got docked from my FMLA leave.
