boy that was killed by LIRR - his parents are suing!
DH works for LIRR and heard that the parents of the poor boy who got hit by a train the other night is going to sue LIRR because there is a hole in the fence and the boy was able to access the tracks. now, i feel really bad for the kid, but does anyone else think thats an insane thing to sue for? instead of pointing blame, why dont they look at themselves??? why didnt they know where their son was...why didnt they tell him NOT to go on the tracks? it just sounds absurd to me.

My DH works for LIRR too. I told him that the parents were suing today after reading it in the paper. We both agree it's kind of ridiculous. Of course, we both feel terrible about what happened. But, the kid was writing grafiti and ran across train tracks. Without trying to sound harsh, he was at fault! I'm really not trying to be insensitive, but reasonable. Ya know?

of course they're suing. it's the American way.
the LIRR said that they have over 700 miles of tracks on LI. are they supposed to put a fence around all 700 miles? sure... right after that, it will cost $1000 a month for a train pass.
at some point, common sense has to take over. the kid was 12, not 1!

I am glad to hear I am not alone.
I know it is tragic and it must be really hard for the parents. Yes the LIRR should have fixed the holes in the fence.... but where the heck were the parents while there 12 year old son was climbing onto the tracks to paint graffiti??
IMO The LIRR should not be held responsible for a boy who was a graffitti arist, which last I checked wasn't a legal activity, because a young boy made a stupid decision.
Again that is JMO and I don't expect everyone to agree.

I'm in agreement with you all. And what if the fence was in tact and kids purposely destroyed it to get thru and onto the tracks? Is the LIRR still responsible for not making an indestructable fence? I'm sure they'll get a few bucks anyway.
I think parents should keep better tabs on their kids, who their friends are and what they're doing.

Lets see, he was defacing property, out at dark on the train tracks with his friend who had the sense enough not to be on the tracks and his parents had no idea what the kid was up to.
Yeah, the case sounds bullet proof!

It's very sad, but I hope the case is thrown out. The LIRR was not at fault. People need to have some sense of personal responsibility.

This pisses me off. He's dead, nothing is going to bring him back and to be quite frank, he shouldn't have been there and he was committing a crime. I feel terrible that he died but it is nobody's fault but his own - and maybe his parents for not teaching him not to do stupid things like this.
The LIRR should have no liability in this whatsoever.

I am sorry this kid is dead, But i have to agree with you all he was there on the track's to do graffiti and that is against the law, his parents should have kept a better eye on their son and teach him from right and wrong. I definetely see this case being either dismissed or going for the lirr because they are not at fault.

As soon as I heard about it I knew they would sue....No one had a gun to his head telling him to go through that hole and write the graffiti...I am very sorry for their loss but that is insane

People will sue for anything..... someone I went to school with was on the roof of the JR High smoking wacky weed, fell through the skylight into the gym....long fall, quad for many years afterward ( passed recently) they sued for not having gates around a skylight or some such nonsense.

Ummmmm....let me get this straight - he is defacing property and trespassing, but it's the LIRR's fault? Talk about frivolous, time and money wasting lawsuits!!!

I have to agree with everyone here.
These parents! I feel bad for the boy of course but the parents just anger me- instead of placing blame on themselves for not knowing where their 12 year old was, for the fact that he was defacing property and trespassing and that he should have known better than to be ANYWHERE near the train tracks... Instead of looking at themselves and saying OMG what a tragedy we allowed to happen by not knowing where he was and the fact that we did not teach him to know better- they blame it on the LIRR and are now trying to cash in on it?
I mean, not to sound harsh but your son isn't even cold yet and you are immediately thinking "CA-CHINNNG"?! Let's try to keep our eye on the ball here- you effed up, you had no idea where he was and he got killed as a result of him being where he should not have been!
Sad on so many levels

I think it is ridiculous for them to sue. Even if the LIRR fixes all the holes in the fences, I am sure a bunch of kids will just come along and make new ones to get through.

You know what pisses me off the most about this? We are going to be the ones that pay in the end. I agree that this was a tragic accident and yes the fence had a hole in it that could be dangerous if a child who didn't know right from wrong wandered in. But a 13 year old who was crossing the tracks to deface public property? This child knew the dangers of crossing those tracks. I am very sorry for the loss of the family and my heart goes out to them. But the LIRR should not be sued over this.
