Um...ok I grew up about a 1/2 mile from the train tracks and there are NO fences anywhere around it.

It's common sense not to walk on the tracks. It was a tragic accident, but you can't blame the LIRR.

I agree with all of you 100%. But the media has a way of twisting the story, not telling the whole thing, etc. Maybe there were, other additional grounds for the suit. Also, when cases like this get dismissed, all anyone ever remembers is that there was a suit to begin with, not that there was any justice.

This is awful fast for them to start a suit though. Makes me wonder!!!
