breaking apt lease....anyone have any experience with this?
In May, it will be 2 years that I have lived here.
My lease is up May 5th.
Breaking the lease results in one month's rent.
I would love to get out of this.
My kid can't take living with these carpets any longer.
We are suppose to close on 3/28.
so if I give notice today, that would have us moving out on 4/3.
would they really charge us for the month?
we have broken leases before, but DH's company always paid for it.

I would talk to management. They might let you out early since it's only a month. If they do agree to let you out, make sure the terms are written down and that it's signed by both parties.

We did it and they didn't charge us, but they were glad to get us out because DH had been there so long, they would be able to jack the rent way up.
Janice, if they make you pay the final month's rent, then just tell them you won't be moving out until the lease is up. If you have to pay it anyway, don't turn in your keys and use the extra time to take your time with moving if you want. There is always the possibility of the closing getting delayed, too.
If you tell them you won't be leaving a month early, they might let you out with no charge so they can get in and do whatever improvements they need to before renting it again.

Yes I can definitely see them charging you for that one month. Your lease is up in May anyways. I would just live out your lease.
ETA: You can definitely ask if you can end your lease one month early. But they may just say no.

Yeah, they would probably charge you for the last month. Or did you levae a deposit? They may just not give you the deposit back.
I agree with the above, and would keep your lease. I wish I had had some extra time to clean/st up my new place before I moved in.
We got the keys on a Saturday, and had to be out of the old place on Thursday, and it was such a rush & there are things I still haven't done 2 years later, because I didn't get chance to do them before I moved in.
Congrats on the new place!

they are super nice and very understanding.
no deposit was ever given.
I am totally open to keeping the apt another month instead of paying to break lease, I sort of don't want them to think that is an option I am okay with though up front.
We had a very rocky beginning with them, so they always walk on egg shells around us. Last may I told them I did not appreciate the rent increase, so they lowered it. (when we first moved here-they moved us into a roach infested apt! needless to say I moved out that night, into their model apt and the first apt available was ours-a bigger more expensive one, but at original rate-that's why I think they will be so happy to have me gone....they are completely losing money by having us in this apt)
jen-my dr is completely prepared to write a note saying no carpets! and I have my receipt for my asthma dyson. I was thinking I should even take pics of new place to show them it is carpet free.

I think being honest is the best way to deal with this. Explain what the medical issue is with your son and that should be enough. You are giving them ample notice.

Did they install carpets while you were living there against your choice? Or was the carpet already installed? If the carpet was already there... couldn't the landlord simply say you chose to live there with the pre-existing carpets?
Taking pics of your new place doesn't really prove anything.

I think you have a good chance of walking away early if you give them a lot of advance notice. If they have ample time to put out a notice and get new renter's, I can't see them making you stay an extra month. Good Luck!

yes they will , maybe you can ask but they are entitled to it, im that case you can take your time moving out....

yeah, we did not know he had asthma when we moved it. The asthma is all new to us.
So I went and talked to her.
We made a compromise. Since 30 day notice is 4/4...I will pay all of april since the prorated rate of the 4 days in april would be high anyway.
they would forget about the week in may.
she said almost everyone in here leaves because of home purchases so she has to be fair across the board.
so that is fine. since my first mortgage payment is 5/1...my last apt payment is 4/1. I won't be greedy...

On your contract there should be an ON or ABOUT date of when your closing date will be. I am assuming that this date is March 28. Both parties (buyer and seller) are entitled to extend that out upto 30 days, after which there is usually a penalty as per the contract language.
I personally would aim for a closing date around april 15 (tax day) and use the remaining 2 weeks for overlap.
As someone else pointed out, the on or about closing date is just that a date on a piece of paper. Very few people actually close on that date. In fact, it is more likely that it is delayed.
