car accident.. wwyd
my brother got into an accident last week.. not his fault.. a 17 year old jumped a stop sign and was speeding and crashed into him (he did not have a stop sign).. he's ok, car is not..
he has geico and the 17 year old has geico.. police report was obtained, then geico called my brother for a statement, which he provided. now they can't get in touch with this girl.. she will not pick up the phone or return any calls.. our car is being fixed from our insurance and then geico will reimburse.. this song and dance has been going on for a week now.. should we threaten legal action against her? or let geico try to get in touch with her again.. but then for how long?  help!! TIA!!

I'd let the insurance company take care of it. As long as you are not paying a deductible, and it is being put on her side of the insurance, let them go after her.
I wouldn't threaten to sue unless I was ready to act, or unless someone in my car was injured.

You don't want to be accused of harassment and cause more issues. Let them do their job. As long as your car gets fixed, no one was hurt, no skin off your back kwim?

You have 30 days to fill out and file this form - MV 104 in New York state or you will be precluded from EVER filing a lawsuit against this other person. Filing this form with the DMV does not mean you're starting an action or anything. But if it's not filed within 30 days of the incident, your hands will forever be tied.
It's a pretty self-explanatory form. Just have your brother keep a copy for himself. I know it looks almost identical to the form the police filled out, but the claimant must fill it out as well and it's a little different.
You can just mail it in yourself. If he were to go and get a lawyer now, they'd advise him similarly that this form must be filed asap.
That being said, the insurance company will totally take care of it. Especially since it's the SAME insurance company! My car got hit by a truck a few years ago when it was parked and the entire thing was covered by their insurance. Geico did everything. It was a little annoying, but worked out in the end.
I just wanted to mention about the MV 104 form because if g-d forbid something were to happen to your brother and he finds he's injured later on, he wants to be able to file a lawsuit under no fault.
If you're not in NYS, though, ignore everything I said because this is only NY law.
Oh, and it only applies to a personal injury law suit. A property claim is separate, but your insurance company has to take care of that. You can't file a claim for property damage and collect through your insurance company too.

we were rear-ended by a lady oct 4 on Staten island expway we got a police report she admited she turned around to help her kids and stepped on the gas
we both had geico and we had the hardest time its so much better when its not the same insurance co
the same thing happened where the lady will NOT respond so they said she has 30 days to respond by phone then they give her another 30 days by letter. they finally just recently came out and approved the repairs to our car, since she still has not responded.
It has been the worst expirence. they never call us back we are always chasing them down etc. I HATE GEICO!!!!!! as soon as this is resolved we are gone. there is a reason their rates are so cheap, its because the cut corners and the service they provide stinks!

Thank you, Sandra! My brother didn't want to file anything on personal injury related.. but I"ll send him the form. This process has been sooooo annoying, to say the least.. especially with the holidays.. when our claims guy is available, the other one isnt.. then thiis girl is MIA.. but I'm soo glad to hear that Geico did everything for you..

I'm so sorry about that! Ouch! So far Geico has been good.. our claims investigator called us multiple times to keep us in the loop.. o man! I'd be fuming if I were you.. so I totally understand. I just want to be done with this.. I'm glad your incident is getting resolved slowly..
