I really don't think she is going to get he death penalty. I believe there is too much reasonable death to come to a conclusion of 1st degree murder. I believe manslaughter is the most likely and that does not carry a death penalty sentence, correct?

Not really, the defense never showed any other possible reasonable story....or even unreasonable...they showed NO other possibility. I know the burden of proof is w/the state and they've done the best they could w/the circumstantial evidence.
Exactly. The only thing they have are the internet searches, but there is too much mystery, too many people with access to the computer etc. But hey look at Scott Peterson...convicted with DP on all circumstantial evidence. we can only hope
I think there is reasonable doubt. The prosecution was supposed to prove that Casey premeditated this murder, purposely put duct tape over her mouth to suffocate Caylee. That was what they were supposed to prove if im not mistaken, right? I dont really think they proved that.... especially since Kronk says he moved the skull, thus possibly the duct tape. Cindy gives doubt with the internet searches, which was another of the prosecutions evidence towards premeditation. I think there is definitely doubt for premeditation and cause of death. I still dont know how the poor baby died. Was she suffocated? Poisoned cuz of chloroform? Suffocated in the trunk? We still dont know and the medical examiners cannot give a reason for death either. I think theres where the reasonable doubt lies.
Of course the defense proved nothing either and its clear casey is guilty of something. but as far as proving of what shes guilty of....no one knows the truth except her. I dont think she will get the death penalty because of this...which I kind of like. She is so vain, narcissistic etc that i think it would be worse for her to spend her life in jail rather than dead. For her to not use facebook, have the common freedoms we have like go shopping, get a nice haircut, eat a steaming hot plate of baked ziti ever again - i think this would do more damage to a sociopath like casey who loves attention, being around people and charming them, partying, living it up and so forth.

They have work/time cards today that will show Cindy WAS at work so she couldn't have done those internet searches.
Leonard Padilla on HLN last night was saying (he's spent time w/CA), that she was giving Kaylee Xanax to sleep...then she ran out of that Rx and was looking at how to make chloroform to put her to sleep and "accidentally" killed her
Of course the jury doesn't know this...
If I was on the jury, I'd want the DP....she has no remorse.
Do I think this will happen? No...I think she'll get 2nd degree...I hope her psycho/stoic face the whole time affects the jury enough to get first degree...we'll hopefully find out soon

I personally think she is guilty of first degree murder. However, as bad as the defense has been they have poked some holes in some areas of the prosecution's case and therefore I agree with brownie in that I think she will get 2nd degree.
On CNN last night defense attorneys were saying that just bringing the charge down to 2nd degree murder would be a huge win for the defense. That the goal of the defense was to bump the charges down to take death penalty off the table.

I could not sleep at night convicting her of premeditated murder and sentencing her to death. There just is not enough solid, clear cut evidence. The chloroform searches are not proof she INTENDED to kill her. After all, when I think of chloroform I think of people being knocked out temporarily, but not killed. So I believe it's possible she just meant to put her to sleep and things went terribly wrong.
I don't believe she is sorry she died. But that doesn't automatically mean she planned it from the beginning.

I agree with you about the evidence not being clear cut BUT what sticks with me also is the "neck breaking" internet searches along with the chloroform. Of course we don't know for certain that Casey was the one that made those searches but...

See, I also don't believe she intended to kill Caylee and her internet searches aren't any more convincing for me.
I have heard about stories and have searched some pretty crazy things on the internet.... for example, I have looked up internal decapitation. The searches about chloroform, ruptured spleen and neck breaking may not have anything to do with each other.... they may all have been searched at different times for different reasons. I do think she researched chloroform to find out how it could be used to help put Caylee to sleep. Just not convinced on the other things.

This is where I am SO conflicted. I would be inclined to believe that she routinely used chloroform to make Caylee sleep or pass out or whatever, and this last time it accidentally killed her. HOWEVER - if it was truly an accident why didn't she/hasn't she shown any remorse or grief? Why did she rent a movie at Blockbuster that night with her boyfriend? Why did she proceed to go out partying, compete in a hot body contest, get a tattoo, lie to her family about where she and Caylee were for 31 days, make up a nanny, lie to police, etc. THAT is the stuff that gets me. If I accidentally killed my daughter I would be beside myself.
Unless I meant to do it.

it's all soo dang sad to me.. :(
I read all your comments re: death penalty and life in prison..
in all honesty, for me, EITHER sentence is justice for me. I just don't want her out to see the light of day ever again..
if she does get the death penalty, she will probably never actually get the needle between the appeals process and what not..
I would agree with some about the whole accidental death thing but what struck a cord with me was okay, she accidently overdosed her dd.. so she then goes and TAPES her mouth with ducttape and wraps her up and throws her in the trunk of the car for however long and then throws her body into a swamp literally around the corner from her house where all her pets are? I can somewhat write that off to let's say panic, maybe? but then to go out and fabricate this entire story about a nanny, and her dd being at water parks and amusement parks and going out drinking and sexing and hot body contests and stealing her friend's and mom's checks and cc to charge up party clothes and NEVER once showing a bit of remorse or anything?
and what is the explanation for all the searches on internal bleeding and neck breaking and how to make chloroform and ruptured spleen and all that?
a person who truly meant to ACCIDENTALLY do something like this would have perhaps paniced and burrowed themselves in a closet hoping the world would swallow them up hole and would be absolutely insane and beside themselves.. NOT doing what she did..
