Corner lot fence question... updated with pic
our neighbors put up a 6' fence along the street side and down our driveway continuing into the backyard. they did a little straight angle at the corner of the property which seems to be "code". I am wondering if its "legal" for the fence to be 6' high down the street side.
I hope i'm making sense. We are COMPLETELY blind now while pulling out of the driveway, until we are already sticking in the street.
I REALLY dont want to call the town. Its its not to code I was even thinking about offering to split the new fencing materials, but I really am nervous that we are going to get T-boned one day pulling out.
Thanks for any help in advance!

Just call the town and ask what the code is. Dont even give the address. We cant tell you, depends on the town.

I tried that, they said I would have to meet with someone to go over plans... I tried to make it sound like I wanted to put one up
ETA: its town of hempstead if that matters.

Re: Corner lot fence question... Please read
We have a corner lot in Suffolk County.
We have 6ft fence along the front of my house almost to the street corner, it stops about 8 feet from the street.
When we purchased, we were told you are allowed a fence as long as it is a certain amount of feet from the road.
We have no problem seeing on coming traffic and have never seen anyone else have a problem.
Maybe the fence just extends too far toward the street and it is not a matter of the height of the fence?
I would ask the owner who installed the fence if they checked with the town and tell them your concerns.

You are saying the fence that runs along your driveway extends all the way to the street?
If so, that seems dangerous!
I have never seen someone put there fence up like that.

No it's not legal. This should help fence permit
ETA: From the house to the street it is 4' max ht and has to be see through. You can report them to the town and they will have to apply for a permit and put up the proper type of fence.

no, not all the way to the street... it stops probably a foot and a half before the side walk on the corner from both sides... so its like an angle... but if we dont back in... we literally cannot see the cars coming from that direction until our but is hanging out into the street.

Re: Corner lot fence question... Please read
I don"t think I really understand the layout of our area but a fence along the street cannot be over 4' so if they have a 6' with one section going lower it probably isn"t legal. There is a minimum setback where the 6' is allowed to start.
and a corner lot there can be no fence at the corner....fence can start 20' back from the corner

You house is either a side or rear yard of this house depending on it's orientation. Either way from the street to the house has to be 4' or shorter and see through. The house is probably set back 30' from the property line. So that means that the taller fence can not begin until it is 30' away from the property line.

Re: Corner lot fence question... Please read
I live on a corner lot and I wasn't allowed to put anything higher then 4ft in the front yard. Corner lots have different rules... judging from your picture.. .they are definitely breaking the rules.
I would call the town... especially if they had a fence company put it up. Because the fence company definitely would have told them it wasn't allowed. My fence company told me they would put the 6ft up but they wanted me to sign a wavier saying I couldn't make them pay to fix it if I was told it had to be removed. I decided just to do the 4ft.
ETA - When the fence company explained the rules for a corner lot in my town... I made a joke and said "I guess I moved to the wrong town" the fence guy told me it wouldn't matter what town I live in... Most of LI has exactly the same rules when it comes to corner lots.

Re: Corner lot fence question... Please read
Ok so technically you are their rear neighbor but that doesn't matter. If you draw a line connecting the front corner of your house (closest to the road) to the rear corner of theirs (closest to the road) that is where the 6' fence has to end and the 4' can continue from there to the property line (prob 8' from the curb). It goes right of way then curb then grass then walk then grass and then their property line. So they ran the 6' portion right to the line. It is illegal and they will have to change it. Report them to the town and they will send an inspector. The inspector will cite them and they will have to apply for a permit and fix the violations.

The fence to your driveway is their backyard. It's not facing the street so I am not sure (regardless of the rule facing the street) that it would have to be shorter. KWIM?

After seeing your drawing, I don't think what they did was allowed.
I am the "neighbor" in the drawing and our fence goes from the edge of our house straight up to your property line

I am in a different township. But my house is in the corner. Facing the same way as your drawing. I just noticed that their fence goes pass the house to the front street. That was not allowed for us.
I don't think that's allowed.

Are you and your neighbor friendly? Is it possible to speak with them and voice your concern before reporting them to the town? I'm guessing that they would understand that its a matter of safety. Fence companies don't always tell you the rules, I had a friend who just had to pay to take her fence down and repay to have it put back up b/c she didn't have a permit and the fence company told her she only needed a permit if a variance was needed.

Re: Corner lot fence question... Please read
Thank u all so much for the replies. When I got home today I realized that their house is kind of diagonal on the property. I know I see it everyday but didnt remember while I was painting my masterpiece lol. So I'm not sure if it matters but the corner of their property is really their side yard.
I hate this because I really don't want to cause them any trouble but I really am nervous to pull out of our driveway! its been there for a year and everyday it bothers me. It's a fairly busy street and isn't always easy to pull out when u had full view!
Thanks again all!

We are hi/bye friendly.. we have been here 4 years and them maybe 1. They seem nice enough and we are really easy going as well.
They did the fence themselves (with help) and they did do the angle at the corner so i'm thinking that they had an idea of what "code" was. I also think its like ON TOP of the property line but now i'm just nit picking
I dont think I will report them. I just dont have it in me... i'll just go on hoping someone drives by and see's its incorrect.. if it even is

Re: Corner lot fence question... Please read
We are town of Oyster Bay, and our permit application got denied for a 6ft. They said it was considered 2 front lawns and we were only allowed a 4ft, we filed for a variance and won, we are putting up the 6ft next week.
While filing for a variance it was mandatory to notify all neighbors (via certified mail) within a 100 ft radius. If any one of them took issue with the fence, they could contest it the day of the "hearing". No one did.

Re: Corner lot fence question... Please read
When they had the fence put in they should have gotten a permit for that. I'm in Town of Hempstead like you, but I'm in the Village of Valley Stream and they have very strict codes. We have a 6' fence in our backyard. If we wanted to extend it to the front of our house it would have had to have been 4'. My ILs are in the same town and have a corner property and along the side of their house were only allowed to do 4'. There is some dumb code that you have to have a 4' fence then come into your property a little bit then you can do 6'. I also know their neighbors across the street (also on the corner) wanted a 6' fence for their backyard but it wasn't allowed. But if you had a pool, you could get it. They got the pool permit to put up the fence but don't have a pool.

Re: Corner lot fence question... updated with pic
I have this same problem! I don't even want to park in my driveway because backing out is a huge issue since we can't see the sidewalk until we are on it. Our neighbors who put up the fence have 2 little kids that run up and down the street playing and riding their bikes. We just moved in and I guess the previous owners didn't have a problem with it so I feel funny mentioning it to them.
