I am in suffolk and on a corner and was not allowed to put a 6ft fence with a certain about of feet from the street when we did our fence 11 years ago. I do not remember the exact numbers but it was alot, like, 20ft from the street or something llike that.

If you really want to do something about it, call the town. No one else is an authority on the town code, so I wouldn't trust anything else. No offense to all those who offered their opinions or experience, but it's the town that has the final say.
That does look dangerous and I often wonder how people who live in houses with that situation feel about pulling out. I see people who live on busy roads backing into their driveway to make it safer to pull out. Add in the sidewalk and it's an accident waiting to happen.
Can you put up one of those bubble mirrors for safety?
I had a similar fencing challenge and put ours 10 feet off the street (no sidewalks) and it's only 4 feet. I purposely do not grow anything tall close to the street for safety.

I have this same problem! I don't even want to park in my driveway because backing out is a huge issue since we can't see the sidewalk until we are on it. Our neighbors who put up the fence have 2 little kids that run up and down the street playing and riding their bikes. We just moved in and I guess the previous owners didn't have a problem with it so I feel funny mentioning it to them.
We are across from the high school so come 2:30 there are tons of people walking home past our house... just this morning I am going to start backing up and I see an elderly man pushing an umbrella stroller. From my minivan I never wouldve seen the low stroller until it was too late... something has to be done

I'm in TOH and have a corner lot with a similar set up to your drawing. My 6 foot fence changes to 4 feet (and becomes see through) along part of my neighbor's driveway. When I bought my house, I had major issues backing out of my driveway (different issues) and called TOH to figure out what to do because I couldn't take it anymore. I also live close to a school with lot of kids walking by. After 8 months of filing permits and having a survey done, changes were made and I can happily back out of my driveway. Luckily, my neighbors were understanding and didn't file a complaint about the changes we made through TOH. I learned the previous owners rarely parked in their driveway and didn't do anything to fix the situation.
Anyhow the point I'm trying to make is that if it's dangerous and difficult for you to back out, I would address the issue. The last thing you want to do is get into an accident or hit someone. I would investigate whether they did their fence wrong or not, have a friendly chat with your neighbor, and then take it from there.

ETA: From the house to the street it is 4' max ht and has to be see through. You can report them to the town and they will have to apply for a permit and put up the proper type of fence.
We are town of Huntington and it is exactly the same for us.

While I am not one to make waves or cause problems or say much of anything - I am very non-confrontational, the one instance where I do speak up is when others safety is at stake. Whether you call the town or speak to your neighbors, you should absolutely address this. Think of how you would feel if someone (those in your car or someone coming by) was injured b/c of this fence. Especially when it's so avoidable. It may be a little pricey for the neighbors to fix, but safety absolutely must come first.
Another big pet peeve I have is when people have large bushes (that may be completely to code) that block a view around a corner and means a driver can't safely see cars that might be coming. My parents had this and no one complained - however, once I started driving, I mentioned it to them (they had a van and could see, but my little car, vision was totally blocked). They took it down pretty quickly b/c they did not realize that it was blocking other's view. We're just really happy that no one was hurt in the meantime.
I'm rambling, but my point is that if you point out it's a safety issue (if you talk to them) or keep that in mind when you talk to the town, you are completely justified.

Didn't read through all the responses, so I apologize if it's been solved or not, but my parents are also in TOH on a corer lot and their 6 ft. fence had to be a certain amount of feet back on the property... There's no way a 6 ft. fence could be on the property line like that!

is it possible that your neighbor filled for a variance and it was approved? you would have recieved a letter in the mail, but maybe you didnt get it or realize what it was?
He is only allowed to put a 4ft picket fence there by TOH law unless he filed for a variance.
ETA: however it would be OKAY if he took that down and put a 4 ft picket fence with 10 foot tall shrubs along it there as well... but that is the TOH for ya.

In the town of hempstead the fence is not allowed to go past your property. We're looking into getting a fence installed and this is what we were told.

I dont think they filed for a variance because we never got anything... although even if we did get it we would've approved it because are so easy going. We wouldnt have realized what a huge PIA it would be to pull out every.single.day.
My DH said the other day that he remembers the old neighbor who lived there telling him that he got in trouble for his bushes being too high by the street and had to cut them back... so i'm thinking this is definitely not legal.

We have a corner lot in Suffolk County.
We have 6ft fence along the front of my house almost to the street corner, it stops about 8 feet from the street.
When we purchased, we were told you are allowed a fence as long as it is a certain amount of feet from the road.
We have no problem seeing on coming traffic and have never seen anyone else have a problem.
Same here. The fence needs to be set in a certain number of feet to be legal. I would report it to the town.

Hello Marie:Had a similar problem with my neighbors and reported them to the town of hempstead because it is a very dangerous issue as You are well aware.They had no consideration for my family when they put the fence up and i felt it was in my familys best interest to get this situation corrected.It will probably take about a year to complete but since the illegal fence was erected i almost hit 2 individuals while backing out of the driveway.I do hope you will no let this situation remain a thorn in your familys side!!!!

My parents are in Huntington and they have a 6 ft fence from the middle of the house going to the street and then the entire street and back. BUT their back neighbor does not have a driveway on that side street. It's on the next street. I guess that's why it's allowed.

The fence is illegal and dangerous. go to the building dept 2nd floor in Hempstead, and fill out a complaint form. The fence will magically disappear within a few months. if not, they owner goes to court. yes, the town will issue a ticket, and the judge will tell him to remove the fence.
You may save a life.
also, corner bushes are illegal. as they block site. But the town will not take action if no one complains.

We had a similar situation with bushes that blocked our view when pulling out. It bothered us, but then when we had our DD, we could not see a thing until she was already in the road (in the backseat). Wr spoke to our neighbor and they moved the bushes. I would speak to them or call the town. It is selfish of them to put other in danger like that.
