Customer Service Question - WWYD? - UPDATED in first post. I'm so ticked off...

I'll try to make this brief:

June 2010 I had Empire install 7 carpets in my house.

They took a day longer than they had planned and there were some immediate workmanship issues, but I was going on vacation for a week, so I didn't address anything.

August 2010 came back from vacation and noticed a lot of hard bumps and lumps in my carpets and generally it felt like there was NO padding down.

Sept, Oct, November 2010 - numerous visits from Empire folks telling me there was nothing wrong with it.

December 2010 - they tell me they will allow me to select a new carpet - send someone out with samples on Christmas Eve.

I select the new carpet - get a call later that day that the "upgrade" will cost me $4500. (They failed to mention there would be any cost to me.)

I tell them no way, this is not my issue, it's a defective installation.

February 2011 - they send an indepedant contractor (I kept calling him carpet CSI) to investigate.

Last week his report comes in - defective padding, need a full replacement.

Empire calls me and tells me they are going to replace it. I ask how long. "A couple hours."

Go to schedule it, talk to the installation manager who tells me it will take a couple DAYS. Not hours.

I have my house on the market and realtors showing it daily.

I don't want it replaced at this point, I just want a refund.

Do I have a case to ask for that? And if so, what tactic should I use?

I've probably had to take off from work 8 extra days since July to handle this.

And I don't trust that they will fix it the right way after how they handled everything else.

This is still going on.

I've been calling the dude Peter that I've been working with everyday for the last 3 weeks. No response.

Today a new guy, Tim, called and offered me $800 - 10% of what I paid.

I told them no and that I wanted to know how much it was going to cost to replace the padding and I wanted at least that cost.

He doesn't know how much it would cost "They don't work like that".

Okaaaaaay. So you don't pay your workers???? So I didn't pay for labor???

After almost 40 minutes on the phone we couldn't come to an agreement so I told him I wanted the offer in writing so I could take it to my attorney.

He said fine - give him the attorney's direct address. I told him I wanted the letter and I would take it to him.

I asked him to also include the PO so I could see my original payments. He refused as "that wasn't something he had access to."

Okaaaaay. But you just listed my PO number and all the details???

I asked if Empire had a facebook page or something else that I could see information I would need to give to my attorney and he said "I don't know."

Okaaaay. The manager of customer service doesn't know?

I tell him where to send the letter and he says he can only send it to the old address.

I asked him why because he knows my situation and he knows I don't live there anymore. Then I said I really don't understand why he wants his customers to be this uphappy he said:

"You mean nothing to me. You are just a voice on the phone."

When I got upset at that and told him that this was the single worst customer service experience I've ever had he hung up on me.

What do I do now?

I'm beside myself at how awful this experience was.

Do I just let it go?

Do I get an attorney?

Do I take the $800 sucky dollars?

Do I try to get someone else to help?

I would say so. Tell them you will call the BBB and figure out the appropriate government entity that would have som power over this and threaten with that if you need to. I would just start out being very nice-get right to the top decision maker and make them feel for you.

You can absolutley tell them you want a refund. They didn't do the work you paid for and you will no longer own the house soon...you want your $ back. Plain and Simple.

Ask for Supervisors or Managers and go as high as you need to. Call Corporate if you need to.

I agree. I think asking for a refund is totally appropriate; also, at this point, it seems a wash for both you and Empire.

I think you have a case for it but it also depends on what your contract says. Their independent contractor says it's defective so that's huge.

at most, I would say they will refund the padding only since thats what the person said was defective. I'm sure thats gonna take some time to persuade, and really theres no basis behind sueing, because if it is defective, and they are willing to replace it, there's no arguement. They just suck as a company and are trying to tire you out, but theres not much that can be done IMO.

If the carpet would all need to be replaced to a new owner, your gonna lose some offers as well. So I would try to right it in the least amount of time as possible.

I would threaten the BBB complaint to a manager, see if they can right things faster?

I think they did not address your concerns immediately and I'm sure upon countless conversations you told them you were trying to sell the house.

There is so much you can threaten with.

We are talking months and now that you want a refund I'm sure they will fight but forget the BBB because they pay the BBB to be listed with them. Call Consumer Affairs where they have to behave to keep their license.

I would speak to the customer service manager and see what they have to say about a refund. If that fails did you pay for it with a credit card? Could you put in a dispute?

Um, wow. Having never been in a situation like this, I'm not sure what an attorney could actually do for me, but I don't think it could hurt to consult one anyway to find out. That is ridiculous, and I would absolutely want more than $800 refunded!

Even if you have him send whatever paperwork he's sending, do you have your mail forwarded? You'd still get the letter that way.

I wouldn't let it go. I would draft my legalish sounding letter, have my friend who is an attorney look it over for suggestions & ask if they would send it for me.

But that's me. The person who went back & forth with Stainsafe for months over pen that wouldn't come off our couch. Once I send certified letters & cc'd BBB, Consumer Affairs & the Federal Trade Commission, I was able to get the full value back. I love a good debate.

If you don't have the energy to fight it, I understand.

I'm no longer living there.

I told them I would have been happy to accept the replacement straight out if they had resolved it in August. But it took them almost 8 months of me begging and calling over and over telling them there was an issue.

So the issue is now I would have to take vacation time from my new job, get someone to watch DS, drive 2.5 hours to NJ for two days AND take my house off the market for those two days.


I know I'll still get the letter, but the fact that he "couldn't" send it anywhere else was just such a cop-out bogus thing to make me mad.

I mean, how could he sent it to my attorney's office but not be "allowed" to send it to me.

I should have just told him my attorney was at my new address. Chat Icon

I wish I had thought that quickly!!

I'd start sending certified letters. Don't let this go!!!

And yes, they are trying to get out of dealing with this issue. I can't believe they hung up on you. I'd be inclined to go there in person (although i'm sure you're 2.5 hours from them like you said).Chat Icon Chat Icon Chat Icon Chat Icon

Sue them. Ask an attorney to write a letter threatening a lawsuit.

Name names.

Send a letter to Human Resources at Empire about this manager. CC him, the attorney general and consumer affairs.

Tell them he lied, is essentially losing business for Empire and is a detriment to the firm.

Good luck.

Don't take the $800!!! No way.

holy crap!!

no one deserves that kind of treatment. Can you go above his head to the president? keep calling and don't stop unitl you get someone above him.

And I agree with Barb, draft a letter and send it off. Most compaines don't want the bad press associated with a lawsuit so they may settle quickly.

I worked in customer service for some big name companies in the past if I EVER EVER EVER said "You're just a voice on the phone, you mean nothing to me." I'd be WALKED OUT.

There's no excuse for that kind of behavior no matter how irate or nasty a customer is being toward a customer service rep. (And I'm sure you weren't nasty).

Don't let it go. Keep calling until you speak to Mr. Empire if you have to, also the suggestion about cc'ing HR is a good one. Write letters. Do all that, but don't let them "win".

You should make a complaint with BBB and call their corporate office and speak to a higher up. I would also write a letter to the corporate office so you have everything documented.

I HATE Empire Carpets!!!!.................we used them in 2006 and they did an absolutely awful, horrible job with the installation and the carpets were so so cr@ppy. I was not happy with them at all. Hope you're able to resolve this issue with them.
