This story angers me so much! I know you don't probably have a lot of "free" time but here are some things I would consider doing:
1. Sue them in small claims court - it's easy to do and at the very least they have to show up, otherwise you win.
2. Write a letter to the NY Post or Daily News about it - they love these expose type stories.
3. Write to the Better Business Bureau online - they will send Empire a letter until they respond.
4. Write a letter directly to their corporate office, Attention: President, stating exactly what you wrote above.

ITA with this- also doesn't Channel 2 have a consumer reporter? What they are doing is disgusting.

This story makes my blood BOIL! Definitely call 7 on Your Side, Shame on You (or whatever Arnold Diaz calls it now), and the WCBS-TV consumer reporter. They would LOVE this one. It's a disgrace!
And DO NOT take a 10% refund -- they can wipe their azz with that!

have you tried one of those Shame on you news segments..that might work!
I was thinking the SAME thing. It gets results and fast. Not to mention that they do a lot of research and can probably find other people this has happened too, because chances are you are not the only one.

I would definitley get the BBB involved at this point..or even (depending on your county) the County office of consumer affairs..sometimes they are a bigger help than the BBB.
DH and I had an issue with a carpet vendor (not Empire though) and the Nassau County Office of Consumer Affairs was EXTREMELY helpful and we had a resolution in about a month.
I do feel your pain, trust me when I say that I do! I hope all works out for you!
