Did you guys hear about the dad
who was teaching his daugther to drive in an abandoned parking lot. She didn't have a learner's permit and she wound up losing control of the car, crashing through a fence, hitting a woman and her newborn child.
Child survived, mother didn't.
They want to put the father in jail. Thoughts?
I personally think it was a terrible accident but not worthy of jail time.

Wow!!! it is a terrible accident but I wouldnt give the Dad jail time. My dad takes my sister who is going to be 16 out driving in a parking lot all the time- of course when its empty and early in the a.m.

I agree... what are they saying about it. Are they giving the dad jail time? was he arrested?

i think jail time is a little extreme in this case. it was an empty lot and i'm sure she wasn't intenting on hitting anyone.

OMG - that's awful!! Horrible Horrible accident, but I don't think jail time is approprate because a lot of parents take their kids to parking lots. This was an abandoned parking lot - if he was letting her drive without even a permit, down the street, maybe that would be a little different...

Assuming she was close to or of age for the permit, I agree. This is just a terrible terrible accident. And, to think of the emotional harm it would do to this kid to send her dad to jail for something she did when I'm sure she's already incredibly distraught...

Then yes, I agree. There was that guy in the Bronx not that long ago that let his child drive and he hit someone (I think a parking lot-type scenario). In that case, that's reckless endangerment and that man should be sent to jail.
How sad. Did they say how old the woman who died was?

My sister is only 15- going to be 16 next month. My dad takes her out once and awhile- same scenerio. I have to tell him about this story...

I agree with you guys, I meant - he should not go to jail. If she was a child, I would have a different POV but at 15 in an empty parking lot - maybe a fine, slap on the wrist since it is illegal but not jail time.

I agree, Eileen. Jail just doesn't fit the case this time.
I think this was just a horrible ACCIDENT, and although it's not legal for her to drive yet, I think a couple of fines and the guilt of killing someone is enough for that family to deal with right now.

While jail time may be harsh, something needs to be done. This father did mess up, laws are made for a reason. If I was a family member of the woman who was killed I would not be able to wash my hands of this. I think every new teen driver should be learning how to drive in a car where the passenger side has breaks as well. This was careless, she did not have a permit, was not old enough....I don't think jail, but maybe a whole lot of community service.

I am on the fence, if she was 16 and had her permit/license she would be held legally responsible for this tragedy. By her guardian disregarding the law and allowing her to illegally operate a vehicle, it makes it more of a criminal act then an accident imo. Maybe not real jail time but much more then a slap on the wrist.

That's an awful situation....I know that my parents let me practive driving in rural areas near our summer house when I was 14, 15. I can't even imagine having my mom or dad go to jail for my actions..even as a teenager. I would not let them....I did the crime, I'll do the time......

I really don't know. The parent did do something illegal by letting a minor drive withouth a license.
I think that may be considered reckless driving, even though the parent wasn't driving, but I'm not sure.
I thihk this should be considered more than just an accident, becus a law awas broken, but it probably also could have happened if the child was 16 & had a permit.

This is my thought too. I am not a fan of bending or breaking laws, generally, but my immediate question when I heard this was, "how would the penalty be different if she did have her permit?" I also heard the story on GMA, where the mother of the woman who was killed (19 y.o. mother of a 1 year old) was saying that she feels badly for the girl driving. The grieving mother said that she feels sorry for the girl because it was a horrible accident and that the girl will live the rest of her life knowing she killed someone. The story also said that the family of the dead woman is not happy about the father being charged with vehicular homicide.
It's awful no matter how you look at it.

Apparently the "abandoned" parking lot wasn't so abandoned if there was a mother and her kid walking around... eh?
The father should have chosen the lot more carefully.

She didn't her the woman in the parking lot. She lost control of the car, the car crashed through a fence, onto a neighboring street and that is where the woman was hit.

If I was the husband of that mother and kid... the father should DEFINITELY get jail time. Thats total carelessness.
There are reasons why we have drivers ed courses that have cars with dual controlled braking systems.

This might be sort of a hijack, but DO all driver's ed cars have dual controls? I know way back when I was taking driver's ed, none of the driver's ed cars had dual controls.
And also, in theory, the father would have done nothing wrong legally if the girl had a permit, so the issue is really that he allowed her to drive without a permit, not that she was in a car without dual controls. So, she would have consequences, but he probably wouldn't have.

Its law to have them at least in NYC. You can't operate a vechicle in NYC with a learners permit unless the car is dual controlled.
Besides... people are also forgetting that this dad didn't even bother to make his kid at least get the learners permit FIRST. Don't you just need to take a written test in Long Island to get a learners permit? He didn't even bother to do that.
You take the chance... you pay the price IMO.
