does anyone know the consequences of not having a 5 year old in a booster seat?!?
my MIL shows up at my house with my 5 yr old nephew in the back seat with JUST the seat belt on...My DH freaked out on her and called his mother at work too!
they told us that "we can't argue with him" "he wont sit in the booster seat.."
WHAAAATTTTTT ?!?!?!?!
He lives with my SIL and MIL and rules the roost..they give in to him for the strangest things and is the biggest spoiled brat and baby I know...but Where is the line drawn?????...when does saftey trump stubborn child..???
i can go on and on with other parenting isssues i have...but i wont ....now... .
i emailed my SIL :
THIS FROM NYS POLICE
but i dont think we scared her at all...
does anyone know exactly what would happen if they were to be pulled over...i want to have that as more scare tactics...

Not much you can say. They've already given in. Nothing you can say can change that. If he's big enough to go into a booster and they get pulled over, I don't know if they get a ticket for only a lap belt.
I would think AJ will be in a booster by 5. but I put 7yr old in my back seat with no booster seat. Just the regular seat belt (with shoulder strap) at his mother's request. She had a broken car, no way to pick up her son. I offered to put the 7yr old into AJ's convertible. She chose the seat alone. Long ride of nerves for me. Yes, it was back roads, etc. But still. *I* get the ticket!
So I won't say I'm a saint but no.. i think kids need the booster seat. Don't like it? too bad. Plus I'm not one that would EVER say "You can't argue with him" I dont argue with AJ, its my way or the highway. I've strapped her into her car seat screaming kicking and resisiting the whole way. I've even spanked her to get her to sit her butt down. She *WILL* sit in that seat. that has only happened twice.
I think these parents have given in. *shrug*

To me, the consequence they should worry about is injury or death.
The first thing this post made me think of was the little boy that died in June. He was in a regular seatbelt, not a carseat/booster.

What's worse?... the kid complaining he's in a seat or god forbid an injury or needless fatality? As long as they fit in a safety seat of some sort.. he should be in one. 5 year olds should not have a vote in the matter.

She (either MIL or SIL, whoever was driving) would get a ticket- a fine and points like GoldenRod posted. A $25 backless booster could save the kids life, how do they not see that (obviously there are other parenting issues though from the sounds of your post)
It's a sad fact that they "can't argue with him" he is 5!!! Unfortunately, and I hope to God it never comes to this, but sometimes the most important lessons aren't learned until its too late.
Safety trumpet stubborn child when the adults in charge realize they are the adults and are supposed to be the ones making the rules.

I agree with all you..the whole thing has me furious...but even though poss death and injury should but doesn't scare them...maybe...just maybe....3 points and up to $100 will
But this def one of the MANY MANY things that he gets away with...we def pray for his teachers.Bec they have created a monster....I can write a novel at the things that go on in that house that we just at!
But I told my DH to tell my mil that if she ever even thinks of putting our kids in this situation..that they will NEVER go in her car EVER!!
I can't get this article...I do not have news 12.. But I can only imagine how incredible sad and tragic it is!

news 12 article: 06/24/12) FORT SALONGA - A young boy was killed in a 3-car crash in Fort Salonga last night, and neighbors say the intersection where the accident happened is incredibly dangerous.
Police say Jennifer Snyder, of Huntington Station, was heading west on Pulaski Road with her sister, 29-year-old Emily Snyder, and her young nephew, 4-year-old Finn Egan. That's when they were hit by a car driven by a Holbrook man who was heading south on Meadow Glen Road. Snyder's car then collided with a third car that had been heading east on Pulaski Road.
Witnesses say Finn Egan had a seatbelt on, but was not strapped into a car seat. He was hospitalized and pronounced dead, police say.
So not worth it. 1 - childs health, 2 - points on license and money 3- car insurance company will increase rates too.

we told both sil and mil..and they just rolled their eyes..like why bother..not worth fighting him...so he wins again.....ugh....
i guess there is just so much me and dh can do!!! now i hope they get pulled over - learn a lesson.. scare the sh1t out of them...
i just hope and pray this news story doesnt become a reality.. smh!

You can lead a horse to water but you can't make him drink. I find that saying especially true when it comes to people who have no regard for child safetly. Keep trying if only to keep your own conscience clean.

There's probably not much you can do. I also work with a woman who had her 4 year old in just a seat belt because he "wouldn't sit" in the booster.
I can tell you, my DD was 5 and I put her in a booster in DH's car (from a convertible carseat) and I didn't like how she could move so much in it. So, I went out and bought a new full convertible carseat. Yea, she resisted, but guess what...I'm in charge, not her!!! Now she is 6 and she sits in it every day...because I say so!! It is NOT her choice...her choice is to not go in the car at all if she doesn't follow the rules.

they'd get a ticket. i cannot count how many tickets i've given to driver's for a child not in a car seat, booster seat etc. and sooo often i hear "but it's not my kid, i'm just dropping them off" or "they won't sit in it" or "they took their seat belt off" etc etc etc. i personally don't want to hear it. all i tell them is that THEY are the adult and they are the driver's of the vehicle, so it's their responsibility to abide by the rules of the road. and even if they think they are just going around the corner or they are a great driver or whatever - what happens when someone else stops short in front of them and that unrestrained child goes flying through the windshield and dies? they don't want to wear a seat belt as an adult, so be it, but give the child a chance and do what's right. uuuggghhh my biggest pet peeve.

Who is the parent?
As far as what can happen? Well, seat belts are designed to fit full grown adults, not children. Boosters position an adult seat belt to properly. Improper belt fit on a child in even a "minor" collision has the potential to lead to:
-severe internal injuries -Paralysis -ejection from vehicle -severe head injuries -death.
ETA: This is in addition to the legal ramifications posted by others.
