engineer inspection before contract?

We signed a binder on our house and have the engineer scheduled to come out on Saturday. Is this the norm, to have the engineer out before you go to contract?

Absolutely. You don't want to sign a binding contract if the house has significant structural problems, termites, mold, etc...Get the report first then sign

I did it that way. Because we had to give a check for the down payment when we signed the contract. I wouldn't want to risk that kind of money on a house I wasn't sure was going to buy.

No, I understand all that... I just read some other posts where people were having their engineer out AFTER going to contract and was confused.

(I'm actually an attorney... but don't do anything even remotely related to real estate law... We weren't signing anything other than the binder without an engineer's report. I thought that was the norm, but the other posts I read confused me. Maybe those other people were referring to a binder instead of contract...)

My attorney told me you can do it either way, but if you can write up the contract in such a way that the offer is contingent on the results of the inspection.

I think its done this way in NJ . I know I have a friend who is did it this way and also some on here of mentioned it as well.

I gotcha.

The binder we signed said that the offer was contingent on the engineer's report... but I guess it can be done a variety of ways.

I know that the realtor has to give all offers to the owner up until the contract is signed, so perhaps if you really wanted the house and wanted to prevent better offers, you'd go to contract right away...

I didn't realize how much I don't know until we started house shopping! Chat Icon
