Family sues AA for selling peanuts in the plane

I understand allergies but she needs to understand he will NEVER be safe.

The whole World is not going to stop eating peanuts.

What will she do when he goes to school? Forbide all kids from eating PBJ in the cafeteria? He can never go to a Yankees game? They sell peanuts.

I feel for her dealing with it but she is asking too much IMO.

Most airlines do however make an announcement beforehand and proceed to not serve peanuts on that particular flight as long as they're told beforehand (I dont know from this story whether they did tell them or not) I think if this family told AA beforehand they could've been a little bit more respectful, peanut allergies are a scary thing.

My little cousins 3rd grade glass got a letter sent home this year stating that no parents could send their children to school with peanuts as a snack nor make any sort of "birthday" cake/cookies are anything that contained peanuts as their was a child with a severe allergy to peanuts.

For little kids, it is really scary & i think they could've been a little more helpful.

As a parent of a child with a peanut allergy I dont blame them. If they say they wont have nuts then they shouldnt. You have a choice to get on the plane or not if they say they are selling nuts. But if they change mid flight, you have no choice to get off the plane and remove your child.

As for school, many schools are nut free, and I would imagine she would choose one like that. Also many parents of kids with the severest allergy choose to home school.

It is very scary knowing something in the air that could so easily be avoided can kill your child.

I read an article about this story, and AA officially states that they can never guarantee a peanut-free flight. They can't confiscate other passengers' peanuts, so there is always the threat of peanuts onboard. I don't know the entire story about what was promised or stated by the airline personnel to the family before the flight, though. I'm sure there's two sides to the story, and somewhere in the middle is the truth.

Actually, at school, yes, they will ask all parents not to send their child in with peanuts, peanut butter, etc. It's not at all uncommon when a child has a severe peanut allergy. Peanut allergies are severe and can be deadly. Most schools (and airlines for that matter) take it very seriously.

I think they have a right to be upset about the apparent rudeness of the flight attendant (according to the article) and their disregard for her son's health.

A lawsuit seems extreme- since there was no guarantee that there wouldn't be any peanuts on the flight- but at least they plan on donating the money if they win.

I did not know schools asked parents to do that.

But in essence how can you stop other people from eating peanuts? Anywhere?

Don't get me wrong, I really feel for this child and his allergies.

While I feel for a little boy with such severe allergies, I can't stand when I see lawsuits like these.

I rarely board a flight without a bag of nuts in my carry on. Knowing a risk like that exists, it's not really the airline's responsibility. An airplane is public transportation. Chat Icon

ITA, my daughter's bestfriend in her class is deathly allergic to peanuts and all the parents in the class were informed to please, please not send snacks containing peanuts. when we go shopping we READ all the labels and it is amazing how much stuff is out there that can "kill" a person with severe allergies. in my house...........we sympathize and help out at all times!

I can understand both ends of the it.

I have a SEVERE nut allergy to pine nuts, i can go into anaphalytic shock from them, but does that mean no one can eat pine nuts around me, no, i take my own precautions. I've had this allergy since i was a kid. I come from a very italian family and pine nuts are very common in lots of things.

Peanut allergies are a scary thing. But it's public transportation, what if it was amtrack or a bus or the subway, do you make sure eveyone riding near you doesn't have any kind of food containing peanuts? i think it's alot to ask the airlines to do.

There is a child in Alex's class at preschool who has a severe nut allergy. We have been asked for several years to not bring in any nuts, which we adhere to. Sometimes it's a pain, but for the sake of every child's safety, I have no issue with it.

I feel for her son and his allergy.. my DH is deathly allergic to eggs and my DD is only 4 1/2 months old and she has a TON of allergies already so I know I have a difficult road ahead of me.

However, the lawsuit p*sses me off. She suffered no damages so wt f is she suing for? Her son did not have an allergy attack. I realize he COULD HAVE, but our courts were not set up to award a person for damages they MIGHT HAVE suffered but for damages they DID suffer. I'm no expert on civil rights but IMO this is a crap lawsuit from angry parents.

I def think the part with the flight attendant was exaggerated. I really want to believe that NO one is that insensitive.

But like i said i have a severe food allergy, I Can die from and can understand a plane is a confined area for certain period of time. I'm also in agreement that the airlines could have taken precautions. BUT for arguements sake, and i'm not saying i would do this...but how Do you tell someone that they cant' eat their trail mix cause someone 50 rows or in a different class of the plane from you has a peanut allergy?

So since i'm allergic to pine nuts, and say the airline decides to serve chicken with pesto sauce for dinner, Do i get to complain that no one on the plane can eat pesto cause I am VERY allergic to pine nuts?
I can even eat a cookie that is next to a pine nut topped cookie, that's how bad my allergy is. The tinest bit of dust, oil makes my throat close, tongue swell and i can get REALLy really sick. I am never without some kind of meds wherever i go.

yup, they do! i work at a school and they are constantly sending out reminders for parents to avoid sending in nuts, etc. At lunch time, there is actually a "peanut free" table where children with peanut allergies have to sit to avoid coming in contact with nuts. they use a special cleaner on it and everything. ( the allergic children are allowed to invite a friend to sit with them at the table, provided that the friend doesn't have any nuts with their lunch). its a little crazy, but these things can be really serious.
so i can see why the parnets are upset, but at the same time, like others said, its public transportation, and the airlines can't really force people to not bring nuts on board. i think its the parents responsibility when traveling like that to make sure their child has the medicine he needs in case of an emergency. ( which it sounds like they did) so i don't think they can do much more than that...

I know what you are saying. I don't think the airline can guarantee anything. Since the FAA deems peanut allergies a disability, they have to take precautions (including menu alterations if they are notified properly) and make annoucements. Beyond that there's nothing they can do about other passengers.

My friend's daughter has a severe dairy allergy like your pine nut one. I am sorry it's something you have to live with - I know it's very difficult. Chat Icon

I really feel for the child, i've had a few scares in my life and the reaction is always worse than the last one. Scares the hell out of me.

It's sad that even at restaurants i get hassled when i ask about ingredients. i can't tell you how many meals of mine were ruined cause they didn't listen to me.

BUT the lawsuit is ridiculous, you can't and shouldn't get rewarded damages for something that COULD have happened. Seems to me like they are sueing because of the principle of it all.

I didn't know peanut allergies are considered a disability by the FAA.

You can't.

I'm not commenting on the article - honestly didn't have time to read it carefully... I was saying that it is common for schools to request that parents not send children to school with peanuts when there is a dangerous peanut allergy. Airlines usually respect this, too. I never said they could prevent the entire world from eating peanuts.

It's a very scary allergy. My cousin's son had extremely severe (deadly) food allergies as a child that he luckily outgrew. They were terrifying - I really feel for the parents of children with severe food allergies.

I can't talk for everyone, there's def different degrees of severity of nut allergies. For me I'm very very allergic to pine nuts, and very sensitive to brazil nuts, i can eat any other kind of nut No problem.

But even if the dust or the tinest bit of oil from a pine nuts gets on something i am eating, i get a reaction and it's an instant reaction.

I never smelled a pine nut, but i doubt i'll get a reaction since i've been around my fair share of them and never got a reaction unless i ate it.

ETA: I can't even touch a pine nut, if i do my fingers swell up.

Here is my take - I have 2 little girls and a DH with severe peanut/treenut allergies.

DD1's peanut treenut allergy is so severe that she had an allergic reaction to a child that had eaten peanut butter and apples before coming to daycare, and shared a toy with my DD1. DD1's eye immediately swelled shut, and the right side of her face swelled, with hives all over the place. Until it's your child you will never fully appreciate the terror I feel everytime my phone rings and I see the daycares name. Or when I drive down Nichols Road to pick her up from daycare and see an ammublance coming in the opposite direction - I say a silent pray that nothing happened between the time I left and then.

All of that being said - I would never fly AA. There are a lot of different airlines that will meet my DD1 (and DD2 and Dhs) needs. When we fly South West - We call ahead of time and they clean the plane and make sure no peanuts are on board - They also let us board early so that I can wipe down seats and tray tables. We also cover seats if necessary. They make announcements, etc.

I am aware that I cannot wipe peanuts off the face of the earth, but I WILL do whatever is necessary to protect my child from people and companies that just don't get it.

You can't, but I imagine, the parents have to be extra cautious on an airplaine, b/c it is an enclosed space & you can't exactly rush the kid to the hospital if need be.

I'm surprised planes still serve peanuts. For a while I only ever saw pretzels, which I think would be cheaper for the airline anyway.
