Filing Bankruptcy question..
Can a Husband file without the wife? What are the new rules? No house is owned. 1 car -owned jointly. really no assets, just lots of creditors.
I used to handle bankruptcies at my old job (paralegal) and I don't anymore. Someone is asking me all these quesitons and I just don't know the answers.

YES THEY CAN - THE ONLY ISSUE MAY BE THE JOINTLY OWNED CAR DEPENDING WHAT IT IS WORTH.....

Yes you can.
You are allowed to have a certain amount of assests - this can be a car or home.
I know someone who is doing this now.

Yes, you can but a portion of the other spouse's income has to be claimed on the means test if you are filing singly but same household.
