you can also try to do something with your mortgage even if your current on the loan. i know u said your house was worth less than the loan. he can write some kind of hardship letter about income even if your not on the loan. my mother in law did that and got her mortgage lowered and she was current.

I'm not sure why if you are a SAHM that your DH isn't helping pay for your debt. I mean, part of his income could pay for daycare if you had to get a job to take care of your bills. Or, he should pay you for taking care of the kids while he works.
Something isn't adding up here.
Even if he didn't pay for part of daycare, if you cleared anything after daycare, its more then you had before.

Most of the responses here assume that the OP is eligible for a simple Chapter 7 bankruptcy and that she will not lose any assets in the process. We do not know the whole picture. For all we know, the household income is too high. The courts do look closely at the non-filing spouse's income and any household income.
It's always up the the individual whether to file but I have never accepted a case with so little unsecured debt. The cost benefit analysis does not really lend itself to filing bankruptcy if 9K really the total unsecured CC debt. Sometimes we find that the other spouse has debt and a joint filing is worthwhile. I think that a consultation with an attortney in your state can answer some questions but on the facts we have, I do not think that your ultimate decision will be to file bankruptcy unless there is a lot more to the story. The student loan debt will remain with you.
