Firing your lawyer who's s'posed to do your closing?

Can you fire your lawyer without having to pay them? We need to close by the end of this month and our lawyer wont' call us back. I spoke w/ him on Monday and he said he was going to speak with the other attorney and call me back to let us know when the closing would be.

Nobody has heard from him. We are cleared by the bank. The seller's attorney, the mortgage people, the bank, our realtor and us have alll left him messages and he won't return the calls. He is the only person holding up the closing.

He said that we only pay him if we get to closing, but he's been very unresponsive so I feel like we need to get someone else ASAP to get this done.

Help!

Consult another attorney asap. Ask that attorney to contact your attorney for all of the information.

right with you! I have been delayed for a month now thanks to seller's lawyer mainly and partially our lawyer.

Have you stopped by his office in person? If you fire him, you'll have to pay him for services already rendered.

I would stop by his office to see what is going on. Is there someone in the office that can help you. Maybe something happened in his family. YOu just never know.

He can charge you for services rendered to this point.

Agreed. Don't be surprised if you get a bill from the lawyer if you "fire" him.

And if you don't pay the bill, I would expect to be taken to court over it. Doesn't mean you will have to pay as you can tell your side of it. But don't expect this to just go away without a fight.
