Do you hae deadline as to when you have to file FMLA?? It is my understadning that you can take upto 12 weeks at anytime the first year of birth, so could you wat and see if your boss follows through?? And if doesn't then request FMLA for the remaining time? I would look at your benefits and see what the protocol is as well as the FMLA laws. I know it is not an answer but hope it helps!

My first thoughts are these: I think you need to make it crystal clear that you won't be returning prior to your 12 week leave. Ask if she foresees any problems b/c you would be more than willing to file for FMLA to ensure that there are no problems.
But then my second thought is: I was wondering if she is someone you really trust? Is her word her bond? I am not sure that I would feel 100% comfortable with just her word knowing that it's being done in a shady way. I would hate for you to jeopardize anything within your company.

FMLA entitles you to 12 weeks of unpaid leave. But your job can be more generous meaning you can still file for FMLA and get paid via vacation, sick leave, etc.
The most important thing to consider is that FMLA protects your job while you are on leave.
I would file AND still work on getting paid while on leave - they are not mutually exclusive.
