East Meadow high school expels hearing-impaired freshman's service dog Play the video (01/04/07) WESTBURY - A freshman at W. Tresper Clarke High School says his school is preventing him from not only learning, but being safe as well. John Cave has been hearing-impaired since he was 10 months old. He and his mother, Nancy, say his service dog helps him throughout the day. Without Simba, Cave says he wouldn't be able to hear a fire alarm or if there were sirens nearby.
The Caves are accusing the school of child abuse in addition to disregarding federal and state law. For the second straight day, the school refused to let Cave in the building with his dog. Since Cave did not have his hearing implants in, his mother says the principal made him wait out in the cold for 30 minutes until an interpreter arrived to tell him the dog was not allowed in. She says the only reason her son had to wait was so the school didn't have to write down it refused to let the dog in. The school has said the service dog is unnecessary since John has hearing implants.
Nancy Cave says the family is prepared to take legal action if the school continues to refuse to let the dog inside.
HOW SAD.

I just don't get it. They showed a clip of the boy and the dog. The dog was perfect with comands. The mother mentioned how it's also important for john and simba to bond right now and get through everything together. It's against the law. I just don't understand its a SERVICE dog!
I also think it's good for the other students to learn about people with disabilities and service animals. How even though they are ADORABLE you can't touch them and stuff.

I understand that some children may have allergies and may be allergic to a dog. But thats not even the issue in this situation........
OR maybe even take attention away from the teachers if a lot of the children want to try and play with the dog also. If I was little, I would want to.
But again, these distractions have nothing to do with what they are arguing about. So in that case, I'm all for the dog being there b/c I dont see their cases to be relevant so much.
But OMG, he is a cutie!

I heard lots of teachers and students are on the side of the boy and the dog. Like I said I think it's good to teach the other kids about service dogs and people with disabilities

There HAS to be more to this story------
The ADA CLEARLY states the laws that federal and public agencies must abide by to accomadate those with disabilities.
As of now- that school is totally in violation of the ADA.

I read a more expanded version of the article which says that they allow service dogs, but only after some kind of approval process with the school/county. The boy's parents never went through with the arrangements, just sent him to school with the dog.
And the school is saying that anything he needs the dog for is handled by the school. If there is a fire, the teacher would handle getting the children out of the classroom, etc.
That said, there are many benefits to having a service dog with him. The biggest one is having children who would normally shun a child who is "different", but instead approach him to pet his dog.
There are better ways of going about this, it sounds like the school and the mother are making it more difficult than it really has to be.

I totally agree with that. BUT I also think that if that happened the dog should know what to do. Like the dog should learn during fire drills...

I knew there had to be more to the story than this.
In this day and age, there is a heck of red tape. I think that if the parents failed to properly register the child and the dog, then they don't really have the right to be suing everybody. It sounds to me like the parents are at fault for failing to follow the procedures instituted by the school.
Just like you can't just send a child to school- you have to register them, I think it is totally reasonable to require the parents to go through the registration process for the dog.
Also, how was the kid left in the cold for 30 minutes? Where were the parents? Was this the child's first day of this school?
Something sounds a little off to me
ETA: This is of course if there are already procedures in place for attending school with a hearing aid dog. If there are no set rules on this, then they should be able to attend classes without any problem.

The school wouldn't let him and the dog in. He is a freshman in high school. I walked to school everyday. My parents were never there. The boy said he didn't have his hearing implants in and asked for them to write down what they were saying and they refused. He waited outside in the cold while the dog lay on the cold sidewalk for someone to come and sign to him.

I'm confused about something. If this is a regular high school, what steps are they taking to accomodate his disability? Do they have special classes with a teacher that can sign? If so, does that mean there are other deaf children with service dogs in the school?

There is more to the story, I remember talking about this with my mom last week when it was in Newsday. On top of the dog, he also has a human helper and I believe a translator.

I agree, but feel like the parents should own up to the fact that they didn't go about this the right way and stop trying to portray the school as being completely insensitive to the boy's needs.

I agree...and the school might be able to phase out the human helper as the dog becomes acclamated...I really don't get why they are making it difficult, just register the dog while he is attending the school???
