I believe NYS is until age 7....(and for some reason NJ is 8 I think)

I do believe at age 8 the law allows you to discontinue use of the booster.
However...(here comes the requisite comment on safety)
Regardless of the law, 4 ft 9 in is the height that is deemed safest to discontinue use of the booster. My DS is 8 and is 4 ft 5 in. and around 63 lbs. He's above the age according the the law. He is and will continue to be in a (backless) booster until he's the 4 ft. 9 in. If he is 4 ft 9 in and the belt does not go across his chest but is higher, he will be in the booster still. Same for my other kids obviously but this is my first one approaching the age.
I am not big on preaching to other parents, especially when safety is not an issue but it's such a simple thing to continue to do for their wellbeing.

I was told 4'9" tall, at least 80 pounds AND 8 years old. If they meet all 3 of those "requirements" then you can lose the booster.

Thanks. I was thinking 8 yrs old since I my son is very tall. But it seems that many of the kids in my neighborhood are done with it now.SO i guess I was curious if I was the only one not allowing this.

This...SD is 8, 4'4 and 52lbs...so she's staying in for a while

I think it depends. My daughter is 10, 4', and 50 pounds. If I followed the 4'9" rules and 80 pounds she would probably be taking her road test in one. Seriously I am positive she will be in high school before she reaches that. So in my case it would be tricky to follow those rules.

We're going off of the 4'9" rule. DS will be 8 in May, but he's 4'2" right now and growing quickly, but he might not be tall enough until he's 9. It's all he knows, so he doesn't care, so I'm not going to push the issue.

DD is 9 and still in one, she is under 4'9", so I'm going to keep her in there until she reaches a comfortable height so the belt isn't too high on her.

Booster seats are for older children who have outgrown their forward-facing car safety seats. Children should stay in a booster seat until adult belts fit correctly (usually when a child reaches about 4' 9" in height and is between 8 and 12 years of age).
they do NOT have to meet 3 requirements. weight is NOT an issue when it comes to backless boosters. as long as they are 4'9" the seatbelt will fit properly without a booster

I was told this by my pediatrician. I plan to stick with this plan anyway, as it seems to make the most sense.
