I'm glad there's more publicity about how awful wal-mart is. my husband is STRONGLY against walmart and made me watch a documentary and he has a book on the company and it really is an awful company. everyone should stop shopping there
I saw that documentary too - Walmart: The High Price of Low Cost.
I'll never shop there.

I feel really really bad for her. Thats horrible BUT She did sign the paperwork. Walmart was legally right. The family should sue the semi truck that hit her!!
I was about to say this, glad you said it first
IT is a terribly sad situation but walmart was legally in the right....sad but true

Re: I am outraged!
I may not be 100% correct on this when it comes to Walmart or any reimbursment for any company's insurance company, but if it follows the same rules as Medicaid, this is how it is.
While it's atrocious and horrible, it's legal.
If you are on Medicaid and you win a lawsuit and have assets, Medicaid can and will come and take the money that they have spent on your care. It sounds like this is the same rule..
I'm not sure if Medicaid won't try to take the rest...they can legally and it's the gov't..wouldn't be surprised.
Now that i explained that, I still think that there has to be a heart somewhere. Many other people aer in the same boat. It's very sad and her quality of life will go down..horrible.

I am not a fan of Wal-Mart, but this policy is not exclusive to them. However given their recent and steady stream of bad publicity, you'd think that they would have "cut the loss" and used this opportunity to re-build their goodwill and public image.
It is a horrible tragedy & even worsened by losing their son in Iraq.

they my not have a choice..if their health insurance company threatens them, they could be dropped. I'm not condoning this at all, but it's common practice and who knows if their hands are being tied by the insurance company.
That being said, if they have a choice, then it's different. I just don't know if they have a choice or not. Large companies rates are dictated by the number of employees and claims experience..if they don't re-coup then they could drop Walmart as a client.
I'm not boohooing for Walmart, but the bean counters for sure are thinking this way. It's just awful.
eta: if this is the case (and I can't say with any certainty) then Walmart should pony up some cash to get her the help she needs and leave the health insurance company out of it..that would be the right and just thing to do.

I was in Super Walmart last night. In other places besides Long Island walmarts are really nice!
I feel really really bad for her. Thats horrible BUT She did sign the paperwork. Walmart was legally right. The family should sue the semi truck that hit her!!
it's not really the point though.
the point is that Walmart *could* let this go..it *could* treat their employees FARRRRR better...but it doesn't.
the point is that it doesn't care...and since I am sure many people feel the way you do...they don't have to.
they know that many people will do anything to save a dime (and that many people HAVE to save that dime in this day and age) so they just don't care.
I have the option of spending that dime and going to a store that *hopefully* does care.
I find Walmart to be BEYOND EFFING DISGUSTING.
I am so glad there will NEVER be one in NYC.
they aren't wanted, and they don't belong.

That is what I was trying to say, but it did not come out right. Even the tightest of tight wads has to know that paying for goodwill can and usually does have a postive affect on their stock & position in the market.
I say shame on Wal-Mart for a lot of things...A LOT but I think that the blame may not entirely lie with them on this case, and I think the media did not tell the "whole" story ....what a shock.

some very large companies..(McDonald's comes to mind) have their own insurance companies for their employees.
I wonder if Walmart is the same?
ETA: Walmart is one company in a position to never have their hands completely *tied*. I am sure in reality there IS something they can do. but they won't. they can't afford to set a precedent of helping their employees.

Not sure, but isn't it just that they have their own administrators for their health insurance? I am not sure if it is the same thing as having their own insurance plan. They are still underwritten and overseen by a 3rd party.
And yes, their hands are never truly tied. With the amount of money they make they indeed could have gone internally to resolve this if they desired. You make a good point that one the precedent is set people may expect it to become standard.

I know that McDonalds had their OWN insurance company, for medical and for workers comp. they created it since they have so many employees worldwide.
it's been a while since I've seen any checks from them though ...so maybe they've outsourced their insurance needs now.

I have worked for some very large companies and they claim to have their own insurance but it ends up being a private administrator that is part of a larger company. Interesting.

Re: I am outraged!
If their plan is truly a self funded plan, then they should walk the walk of shame.
How dare they? Even if they have the legal right, they have no human side.
then again, no insurance company would write that off either.

this *could* have been the issue deep down for all I know (I was on the doctors office end) but we mailed on the face of it, and even with some insider info, it appeared to be just what is was...a self funded program.
susan, I have NO idea if Walmart is self funded.
I just hate them. and don't put anything past them

This is taken from the link I posted earlier:
Wal-Mart's reason Self-financed company or union health insurance plans are permitted to demand repayment for medical expenses if the insured collects damages in a lawsuit or settlement, and they commonly do. Wal-Mart says good stewardship of its health plan provides no other choice.

This is no different than what any insurance company does. While I sympathize with the woman, Wal-Mart is entitled to seek reimbursement.

ITA.
I don't mind Walmart at all. Are they the best employers? No. Do people still work there? Yes. Clearly there is some demand for jobs there or they wouldn't have any employees.
That's the way markets work.

Re: I am outraged!
people still work there because wal mart took jobs away from mom and pop stores.. or other stores, supermarkets, etc. they arent frequented as much as they used to so their company is going down therefore they dont have the payroll to employ people.
wal mart is a TERRIBLE company do NOT support it. they are just as bad as puppy mills. you keep supporting them, the more they're going to produce

they are NOWHERE NEAR COMPARED TO PUPPY MILLS...and while they do a lot of bad business, in this case, they happened be justified in seeking reimbursement.

Re: I am outraged!
ok, they're not AS bad but it's the same idea. you buy a puppy from a pet sotre, you're supporting the puppy mills and they're making money on these dogs. they'll kep producing more puppies. you support walmart, they'll keep staying in business. obviously they won't go out of business cause a bunch of people stopped shopping there, but if you get enough people to stop shopping there, it will hurt their business and could potentially run out of business in that one location.

Don't get me wrong.. I love a good mom&pop shop.. but the American marketplace switched away from them and towards "big box" stores because that's what the American people, in general, wanted.
If there were no demand for them, they wouldn't exist.
Sure, I wish we had more little five and dime shops, and Woolworths, but would I sacrifice the convenience of going to a Wal-mart or Target? Probably not.
And for the record, they don't produce anything.
