I am so upset right now and can't calm down...
a woman backed her car into my last week (see post)...and it took the police 3.5 hours to come...
The insurance adjuster came to my house the following day...wrote up the estimate...
I took the car to the repair shop...there was more damage to the car, so the adjuster came back and wrote up a new estimate with the damages under the hood...
I call today to speak with the agent assigned to my claim, and the woman that backed into me is now claiming that I drove into her...
The insurance company said they're going to call the witness...
But what happens if the witness didn't see everything?
What happens nwo???

they should be able to tell quite clearly from the police reports, the amount of damage and where the damage is on the car.
she's just being a tremendous jerk.

When I 1st read the story, the 1st thing I thought of was the people that do these things to collect insurance money.
Thank Goodness you have a witness!

Chris, unfortunately without the police report and no witness, this is going to be a tough one to prove. What does the original written police report say? The police have to have a copy of the report.

Standing still - it was a red light. There was approximately 3' between my car and hers...She was in front of me.
I have damage to my car (hood/grille/bumper) but she has NO damage to her. There is some of my hood paint on her left rear bumper. Not only was she backing up, but on an angle, so her left back bumper (she's in a jeep) crushed the dead-center of my car...so much so that she rolled up on my car.
She is claiming that I drove into her...any person can look at the damages and can tell that she drove into me...the swipe marks show it.

I still don't understand how there is no report. I would file one NOW if that's the case. I would also call up the precinct to see if the PO filed anything.
Insurance companies often rely heavily on what is in those police reports.
I hope it all works out!

I am suprised the insurance co. will call the witness if they are not on a police report. I had gotten hit at my office and had witnesses, but because we didnt file the insurance company would not accept a witness statement.
I had the same problem, first she admitted hitting me head on and then changed her story that I hit her.

there is one witness..but i haven't spoken with him (conflict of interest) but he handed me his business card directly...so I'm assuming that he saw the whole thing. I'm concerned that he didn't see the whole thing.
I think I'll have to go into the prect. and speak to them directly. The insrance company did say that the report won't do anything b/c both of us have to be present.

You should be ok then
because you didnt file a report dosent mean anything...if u didnt.

Is she claiming any damagess? Are your damages extensive? If so, do you know any auto lawyers (friends, etc.) that might help you out in dealing with this? It might get a little complicated...

police report or not, they can tell just by looking at the two cars what happened.
call it accident profiling.
they can tell the angle the hit was made at, approx how fast, what direction...everything, just from the extent of the damage to both cars.
FILE the report. but don't get too worked up.

Because she changed her story I fought it, it was a lot of phone calls and follow up, but we settled 80% her fault and 20% mine.
