No...I'm so upset with myself that I got "had" by the NYPD...they didn't want to sit there writing it up..."hours" of paperwork.
Even after you waited hours for them? Aw man, Chris. This is gonna be a tough one. I'm seeing a lot of stress in your immediate future. Good luck!

Biggest problem is tho, she sustained little to no damage, so why would she even consider settling on anything when she's got a shot at getting away scot-free?

She is a moron though...I learned that immediately when she wouldn't give me any of her information until the police came.

Yeah, but insurance co's like to have paperwork and they don't like having to pay out. So unfortunately, McL is in the position of first having to prove that moron hit her and then trying to get insurance to pay for it...or better yet, to get moron's insurance to claim responsibilty.

They have professional adjusters that will look at the damage and determine who is at fault. There is NO damage to her car, nor is she claiming there is damage to her car.
What irks me the MOST is that her insurance company came to my house, took an estimate, we took the car to the repair shop, and the same adjuster was called in again to add more to the estimate since there is internal damage to my vehicle.
Why would her insurance company send the estimator and go through all this but NOT contact her FIRST?

Chris, take pictures of the scene. Indicate on them what position your car was in, and where she was in relation to you. Submit those photos along with a VERY detailed account of events. Those photos, along with the report of the damage from the body shop, should show the insurance company that her story is BS. At the very least, it will prove she bears some responsibility! (even though we know that she's FULLY responsible) Good Luck!

Everyone already had great advice - all I can say is that woman is such a beotch!!!! Don't worry though, what goes around, comes around!
And they will definitely be able to tell who hit whom! Don't worry. It's just so frustrating!

Honestly, the police report doesn't matter. It's written after the fact as told to the police by you and the other driver.
I had an accident that was clearly the other driver's fault. There were two left turning lanes (I was in the left, they were in the right)...they made an illegal uturn right into my car. The police wrote the report that way, TOTALLY their fault.
When I called the insurance company, the other driver claimed I tried to pass them on the left...not even possible. They made it 50/50 fault, and I got screwed. They said the accident report didn't matter. So I told them next time I wouldn't bother and I'd just lie
