if someone left a 4yr old in the car....
with the doors locked so they could run into a bathroom at a store or gas station or something what would you do?? lets say the person who did this is the child's non-custodial parent.... and he is on his way home with the child from NJ after spending the weekend there with his girlfriend.. and it's about 12am..... how mad would you be if you were the child's mother??? and what would you do??

yeah i was thinking that also.. it may seem really horrible and like endangering the welfare of a child but it may not really be considered that.

Is it stipulated in the Custody paperwork that he is allowed to leave the state with her? I would be mad, really mad. I would file a petition to get his right to take her out of state revoked and I'm not sure what else you can do.

I would think a 4 year old telling someone of authority that is what happened would be sufficient.

That is just insane! Does your agreement have set times? If not, you need to get them put in there. That way next time it happens, he is in violation. If it's already in there, I would contact the intake dept. at family court directly to see how to prepare a modification to the visitation stating you want supervised visits until you feel like he can be trusted with her. All of these things you have listed are NOT in the best interst of your child and seem like they would be very valid reasons for him to not be allowed to pick her up and leave with her.

I know someone that happened to... his parents left him in the car when he was 2/ He pushed the cigarette lighter in--(old car) happened 40 years ago. It popped out amd must have landed on sometihng. The entire car went up in flames. He is burnt on over 90% of his body--mostly his face. He was pulled out by a woman.

um, no. Sorry but any child unattended is being endangered. Someone one the outside could get in if they really wanted to....the child could get hurt on their own. Way too risky for any child regardless of age.

I'm not sure I would make an issue out of it.
I know I've had my kids in the car (doors locked) while I ran back into the house for a bookbag. I've brought one sleeping child into the house - one at a time.
Being at a rest stop is different than being in front of my house but stilll...I could see the dilemma. Does a man bring his sleeping daughter into a restroom while he pees?
As for having them out late on a school night, if it was a regular basis I would have an issue. If it was a one time thing, I think I would let it go. Again, not being in the situation & harborig any hurt & anger makes it different. It sounds like more of anger stems from the non-custodial parent having the child rather than the actual events.

ETA: Leaving a child in the car at home is completely different than in an out of state rest stop at 12:30 a.m. He should not have had her out that late to begin with and there wouldn't even have been an issue of where he would pee. If this had been you, you would leave your children in your car at a rest stop? I personally would take them IN the bathroom.

ITA First of all I would never leave my child in the car at a rest stop at any time, especially not 12am when it is dark and deserted out.

nah, no anger about him just simply having the child.. he has been in her life since day 1 and we were together for 6 years, 2 of which were after she was born. and we're still friendly.. i have no problems with him otherwise. he does get her home around midnight kind of frequently when he takes her with him to NJ... and it has always bothered me, so i have told him numerous times that it has to stop.. but then he runs into traffic and i cant really get angry at him for that, so i tell him to take his time and be careful so he can get my daughter home safely... but last night was the last straw...... i would NEVER leave her in the car, not even on my own driveway..... a number of things could happen whether it be her hurting herself or something happening to the car or a stranger doing something. so i would never take a chance... and the fact that he could be so careless like that really worries me. thank you all for the support and opinions, i really appreciate them all.

Nope! I dont see it as you being angry. I see it as your dd was in a potentially dangerous situation. Even if it is unpunishable now, at least it is documented forfuture events.

thats true, im saving the text messages i have pertaining to it... i texted him today after we spoke about it last night so i could have some proof in case i needed it. thank you again
